OFFICIAL RULES
THE BLIZZARD AND XFIRE WORLD OF WARCRAFT SUMMER MOVIE PROMOTION (THE “PROMOTION”) CONSISTS OF A SKILL-BASED CONTEST (“CONTEST”) AND A SEPARATE RANDOM DRAWING (“SWEEPSTAKES”) AND IS OPEN TO QUALIFIED AND ELIGIBLE LEGAL RESIDENTS OF AUSTRIA, CANADA, BELGIUM, DENMARK, FINLAND, FRANCE, GERMANY, IRELAND, LUXEMBOURG, NORWAY, SWEDEN, THE UNITED KINGDOM AND THE UNITED STATES, ALL AS DESCRIBED IN THESE OFFICIAL RULES.
As described below, entry into the Contest requires submission of a Movie (defined below), but there is no purchase or submission of a Movie required to enter or win the Sweepstakes portion of the Promotion. Participation in the Contest does not change your odds of winning the Sweepstakes, which depend only on the number of eligible entries in the Sweepstakes.
Blizzard Entertainment, Inc. And Xfire, Inc. are the Sponsors of this Promotion and shall be jointly referred to in these Official Rules as the “Sponsors”, “we”, “us” or “our.”
The Official Rules have certain variations necessary to conform to the laws and regulations that apply to you, depending on where you live, and you should review the Official Rules that apply to you carefully since they are the agreement between you and us in connection with this Promotion.

Eligibility. You must be a legal resident of the
All entries must be made by registered Xfire users, using a registered Xfire user name. There is no charge to become an Xfire user and there is no obligation to purchase anything when you do. You can sign up, register and create your Xfire user name by following the instructions available at http://www.xfire.com. Neither directors, officers, principals, partners or any employees of the Sponsors, nor any of their respective parent, subsidiary or affiliated companies, nor any of their respective agents, representatives, promotional partners, prize suppliers, professional advisors, advertising or promotional agencies, members of their immediate families (i.e., parents, children, siblings and spouse, regardless of where they reside) or individuals residing in the same household as any of these people, are eligible to enter, participate or win any prizes. All of the foregoing individuals and entities will be referred to in these Official Rules as “Sponsor Entities.”
If, for any reason, you are not eligible, you do not meet all of these requirements or you (or if applicable, your parent or legal guardian) do not agree to these Official Rules then you are ineligible to enter or participate and you are not eligible to win. Should you enter or attempt to enter the Promotion, we may disqualify you immediately at any time.
All applicable federal, state, provincial and local laws and regulations apply and this Promotion is void where prohibited or restricted by any law or regulation. In the event of any dispute or ambiguity as to who has entered or the identity of any entrant, unless the Sponsors disqualify the entry (which we have the right to do in our sole discretion) entries will be deemed to have been submitted by the owner of the email account from which the email was sent.
2. Entry Periods.
Contest Entry Period: You
may submit your entry for the Contest portion of the Promotion, which includes your
Movie (as described below), during the “Contest Entry Period” which
commences on

make available on the Xfire website, those Movies (as defined in Paragraph 3
below) we have selected in each category, to be eligible to win prizes in the
Contest. In order to enter the Sweepstakes portion of the Promotion, during the
Movie Voting Period, you must download, view and then submit your vote for the
Movie you believe is the best, in each one or more of the designated Movie
categories, as well as the entry you believe is the Best Movie Overall. The “Movie
Voting Period” begins at on
3. How to Enter.
Entering the Contest: To enter the Contest, eligible entrants must submit a digital "movie" that utilizes content and material (“Scenes”) recorded from the gameplay of Blizzard Entertainment's World of Warcraft game (each, a “Movie”). The Sponsors hereby permit you and grant you a limited, non-exclusive, non-transferable revocable right and license to use these Scenes, including the right to create derivative works, transform or adapt these Scenes in your Movie for purposes of submitting the Movie to the Sponsors, during the Contest Entry Period, in connection with your entry into the Contest. The Scenes are and shall remain the property of the Sponsors or their respective licensors, suppliers, promotional partners and/or any other persons, firms or entities that hold and own the rights to these (including, without limitation, the intellectual or industrial property rights) and we reserve all rights not specifically granted to entrants under these Official Rules. However, the remaining elements and portions of your Movie, including the look and feel and sequence and structure, must be newly created and an original work composed and created by one or more of the individual participating entrants listed and shown in your submission. You may not use any of the licensed Scenes for any commercial or other purposes, other than for submission of your Movie as an entry into the Contest or for your own personal use.
Entrants may submit multiple Movies, but are restricted to only one entry and one prize per category (including the selection as Best Overall Movie) and, for each Movie, entrants must select the category, from the designated categories available, in which that Movie is being entered. Sponsor will not accept as an entry and will disqualify any Movie that has been released publicly prior to the start of the Promotion or that in any way violates these Official Rules. Entrants must include with their Movie submission, the full legal name of each individual who participated or contributed in any way to the submitted Movie, each of those individuals’ physical postal address, each of their email addresses, each of their Xfire user names and the category under which the Movie is submitted for entry into the Contest (“Submitting Information”). Entries consist of the Movie and all of the Submitting Information and entrants can choose one of two methods to submit their Movies as follows:
Submitting your Movie:
Method 1: You may submit your Movie on the Internet by following the instructions at: http://www.xfire.com/cms/xf_wow_contest_summer_form and which allows you to provide a URL to the Movie being entered; or
Method 2: You may submit your Movie by email by attaching the Movie file to an email sent from the submitting Xfire registered users’ email account to: xfirewowmovies@xfire.com. The email entry with the Movie attached must have the following words (and ONLY the following words) in the subject space or line of the email "WoW Summer Movie Contest" and should provide the Submitting Information in he body of the email.
Each Movie must include clear visual graphic displays or audio mentions of Blizzard Entertainment, Inc. and Xfire, Inc. or their logos or distinctive identification and must, at least once at the beginning or at the end of the Movie, feature the Prize Donors' Slides. The official Xfire logo and other official Xfire materials permitted to be used in the Movie for the Contest can be found at: http://www.xfire.com/cms/xf_presskit. The foregoing content and material provided for your use pursuant to the foregoing shall, for purposes of these Official Rules, be considered part of the Scenes as that term is defined above.
Each Movie submission must be submitted in one of the following formats only: ".wmv", ".avi", ".mpg", ".mpeg", ".qt," or ".mov" format. For the Drama, Music/Dance and Comedy categories the file size shall not exceed 100Mb in size or 10 minutes in length. For the Short Feature category the file shall not exceed 25Mb or 2 minutes in length. All text, words, lyrics and other content in the Movie must be in the English language. Any and all music in the Movie must either be the entrant's original musical composition and performance or music from the World of Warcraft game. Movies shall not contain content or material of any kind that violates or is inconsistent with these Official Rules or infringes the rights of any other party, including, any content that contains (or appears to contain), in the Sponsors’ sole opinion and judgment:
o explicitly profane or obscene material;
o endorsement (or condonation) of illegal drug use, alcohol abuse or other illegal activity;
o nudity, profanity or extreme or gratuitous violence;
o any express or implied commercial endorsement;
o any derogatory characterization of any person or group based on age, race, color, gender identity or expression, sexual orientation, religious beliefs, marital status, mental or physical disability, citizenship, creed, national origin, physical appearance, political affiliation, union membership, veteran status or other ethical or unlawful factors;
o any violation of these Official Rules or Xfire's Terms and Conditions that apply to Xfire registered users posted at http://www.xfire.com/terms_and_conditions;
o any unauthorized use of copyrighted or proprietary material, including, without limitation, unauthorized use of any trademark, logo or any individual’s name, photograph, voice or likeness; or
o depictions of any conduct, language or other context deemed inappropriate by the Sponsors or any of the judges selected by the Sponsors.
Entering the Sweepstakes: You need to be a registered Xfire user with an Xfire user name to enter. Becoming a registered Xfire member is free and there is no obligation to purchase anything as an Xfire member. Voting will take place during the Movie Voting Period in the Xfire forums under the World of Warcraft Summer Movie Contest section. To enter you simply vote for your favorite Movie in one or more of the designated Movie categories, as well as your vote for the Best Movie Overall, during the Movie Voting Period. Until the Voting Deadline, eligible entrants will be allowed to vote for their favorite Movie within each category, but only one vote is allowed per registered Xfire member in each category. Voting will proceed until the Voting Deadline and the results of the popular Xfire registered user voting will be used to help determine the prize winners of the Contest as described below. Each vote by an eligible entrant represents one entry for that eligible entrant in the Sweepstakes. Voting is identified by user name as a registered Xfire member.
4. Selecting the Winners.
Selection of Contest Winners: Within each Movie category, the Sponsors will evaluate and select five (5) winning Movies, and they will be ranked by the judges in order of their selection as 1st, 2nd, 3rd, 4th and 5th within each category. Selections in each category will be made by a panel of judges selected by the Sponsors and shall be determined by the judges based on the weighted determinations as follows: Xfire forum/popular vote (20%); selections of Blizzard Entertainment, Inc. (40%); and selections of Xfire, Inc. (40%). The judges shall use criteria which includes, but is not limited in their sole judgment and discretion, to the Movies that display the most original, authentic, funny and/or artistic expression within each of the Contest categories and that is based on the World of Warcraft game. In addition, the Grand Prize Winner and those Movies meriting Honorable Mention will be selected by the judges in the same manner. In the event of a tie, the judges shall re-review and re-evaluate the tied entries to determine the ranking or selections. In addition, if any Movie or any entrant submitting a Movie, that is selected as potential winner is determined to be ineligible or is disqualified or unable to accept a prize, Sponsors shall have the right to disqualify that Movie and/or entrant and the Sponsors shall have the right to move each of the other Movies up in rank, if appropriate and/or select another winning Movie, from the pool of remaining eligible and eligible entries, in the sole discretion and determination of the Sponsors. Decisions and determinations of the Sponsor shall be binding and conclusive for all purposes in this Promotion.
The entrants responsible for the Movies selected in this manner are the potential prize winners and each will be notified by email within approximately fourteen (14) days after their selection. To be declared the winner within the category and at the level designated by the judges, and to be awarded and claim the applicable prize, potential prize winners must follow the instructions contained in their notification which describe how they must comply with these Official Rules, including the completion of the necessary affidavits and release forms or for residents of Canada, in the discretion of the Sponsors, declarations.
Selection of Sweepstakes Winners: The popular vote to select
winners will take place in the Xfire forums, under the World of Warcraft Summer
Movie Contest section. The Xfire forums can be accessed by creating a free
Xfire account and becoming an Xfire member (http://www.xfire.com/download). Each
Xfire member, by user name, is entitled to vote for the Best Movie Overall, as
well as their favorite Movie within each category (i.e., a maximum of 5 votes
if the member votes in all categories). When the voting is completed and the
Voting Deadline has passed, the Sponsors will randomly select 20 potential
prize winners drawn from all the votes cast by eligible entrants during the
Movie Voting Period, each of whom, if eligible, will win one of the Voter
Incentive Prizes described below. The drawing for the Voter Incentive Prizes
will be conducted on or about
If any Xfire member selected as potential winner is determined to be ineligible, is disqualified or unable to accept a prize, the Sponsors shall have the right to disqualify that Xfire member from the Sweepstakes and the Sponsors shall have the right to draw another Xfire user name as a potential winner, from the pool of remaining eligible and eligible entries. Decisions and determinations of the Sponsor shall be binding and conclusive for all purposes in this Promotion.
5. Prizes. All prize values are expressed in U.S. dollars and all prizes will be awarded. All federal, national, state, provincial, municipal and local taxes and any other government fees, duties and charges of any kind associated with the acceptance, receipt and use of any prizes are the sole responsibility of the winner. In order to be declared a winner, be awarded and receive a prize, individuals selected as potential prize winners must execute and return to the Sponsors, within the time period required, an affidavit (or, for residents of Canada, a declaration) of eligibility and a liability and promotional/publicity release (except to the extent prohibited or otherwise restricted by law) before they can officially be declared a winner, be awarded and receive their prize. If we are unable to contact and/or notify any potential prize winner within five (5) days after we start attempting to do so or if any prize is returned as undeliverable or is not claimed within fifteen (15) days after notification of being a potential winner, that prize will be forfeited and awarded to an alternate potential winner determined in accordance with these Official Rules. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsors reserve the right to substitute a prize of equal or greater value for any prize. All prizes are awarded "AS IS" and “AS AVAILABLE” and without representation or warranty of any kind, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose, title or non-infringement).
(A) Contest Prizes: In the Contest portion of the Promotion, there will be a total of thirty-one (31) prizes awarded: one (1) Grand Prize for the best Movie overall, five (5) prizes, ranging from 1st Prize to 5th Prize, in each of the four designated Movie Categories and ten (10) prizes to Movies that are awarded Honorable Mention. If multiple individuals are involved in the submission of any Movie entry, prize awards will be awarded to the individual Xfire registered user that submitted the winning entry.
The following is a list of the prizes (which may consist of multiple items), by award category and Movie category, with the corresponding approximate retail values (“ARV”) shown next to each prize:

Honorable Mention Prizes
For the 10 Movies selected as deserving Honorable Mention, each of the winning entrants will be awarded one Zboard Keyboard (ARV each $50, for a total ARV of $500).
Total ARV: The total ARV of all the prizes to be awarded in the Contest portion of the Promotion is $22,460.
(B) Sweepstakes (Voter Incentive) Prizes:
Xfire registered user members who download and view the Movies may submit one vote during the Movie Voting Period for their favorite Movie in each of the designated Movie categories. Although Xfire registered user members can choose to vote in any or all of the designated Movie categories, entrants are only permitted to vote once in each category and receive one entry in the Sweepstakes for each vote. After the Movie Voting Deadline, the names of twenty (20) eligible entrants will be randomly selected from all of the eligible entries received in the Sweepstakes, to win one of the Voter Incentive Prizes described below; provided, however, Canadian residents are also subject to the skill-testing requirements outlined in Paragraph 4.
The 20 Sweepstakes winners will each receive a Zboard Keyboard (ARV $50 each). If any entry or Xfire registered user entrant is ineligible or disqualified for any reason, another entrant will be selected for that prize from the pool of remaining eligible entries in the Sweepstakes.
The total ARV of all the prizes to be awarded in the Sweepstakes portion of the Promotion is: $1,000.
The Total ARV of all the prizes to be awarded in the Promotion (both the Contest and Sweepstakes portion of the Promotion) is $23,460.
6. Sponsor Use of Movies and Submission Information. By entering the Contest, you (and your parent or legal guardian, if applicable) hereby grant each of the Sponsors, jointly and individually, as well as each of the Sponsor Entities, a perpetual, non-exclusive, irrevocable, worldwide license and right to display, use, exploit and otherwise treat as their own, each Movie and Submission Information and any other information and materials you submit to Sponsor in connection with the Contest (the "Entry Materials"). The Entry Materials will not be returned to any entrant and without limiting the generality of the foregoing, you acknowledge that Sponsors and the Sponsor Entities shall have the right to use, modify, reproduce, publish, perform, display on all forms of media, distribute, make derivative works of, use same in advertising and promotional material, and otherwise commercially and non-commercially exploit the Entry Materials, in perpetuity and throughout the universe, in any manner or medium now existing or hereafter developed, without notice, attribution or compensation to you or any other person or entity and you waive your moral rights in your Entry Materials accordingly. You agree to take, at Sponsors’ expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by Sponsor to effect, record, perfect or confirm Sponsor's rights as set forth above in this paragraph 6. You hereby agree that you will not, at any time during or after the Promotion, commercially exploit the Movie, nor use any scenes from the Movie, other than as expressly permitted in these Official Rules and with respect to your posting or distributing any Movie for non-commercial or personal purposes, you further agree not to do so and to give the Sponsors exclusive rights to display, perform, promote, use and distribute the Movie for a period of 6 weeks from date all of the prizes have been awarded. Upon request, we will advise you of that date.
7. Original Work of Authorship. You hereby warrant and represent that by submitting Entry Materials (a) you own all rights to your Entry Materials, except the Scenes, (b) all Entry Materials, except the Scenes, are original works of authorship on your part or the other entrants you have identified as participating or contributing to the creation and production of the Entry Materials, (c) you have not copied, in whole or in part, from any other work and are not violating, misappropriating or infringing any proprietary, intellectual or industrial property, privacy, publicity or personality or other right (including, without limitation, copyright, trademark or service mark) of any other person, firm or entity, and you are not violating or breaching any law, regulation, agreement or obligation by which you are bound.
8. Collection of Information. The Entry Materials includes
Submission Information that involves your providing to us your personally
identifiable information and such information will only be used to contact you
in the event you are chosen as a potential prize winner, to our suppliers and
others we use to fulfill the prizes or perform obligations related to the
Promotion (and only for those purposes) or as otherwise specifically described
in these Official Rules or in the affidavit and release and related
documentation you will be required to agree to and execute in order to be
awarded and receive a prize. The Sponsors will not sell, rent or otherwise
transfer any of your personally identifiable information to any non-affiliated
third party, nor use such information or allow any of the Sponsor Entities to
use, any such information for marketing purposes without your consent. If we
discover any entrant submitting Entry Materials is under the age of thirteen
(13) years, in addition to disqualifying the entry, Sponsor will delete, erase
and destroy all personally identifiable information that is obtained from such
Entry Materials. Personal information submitted in connection with this
Promotion will be processed, for the purposes of the Promotion, in the
9. General Disclaimer and Releases.
By entering or participating in the Promotion, submitting any Entry Materials and/or by accepting or receiving any prize, you acknowledge, understand and agree that:
(a) The Sponsor Entities shall not be responsible or liable for: (i) any late, lost, misrouted, illegible, imperceptible, unreadable, garbled or distorted or damaged transmissions or entries; (ii) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related delays, malfunctions or failures; (iii) any disruptions, injuries, losses or damages caused by events beyond the control of Sponsors; or (iv) any transmission, printing or typographical errors that may occur or be discovered;
(b) Proof of submission of an entry, does not constitute evidence that the entry was received and if there is any failure, delay or problem with your entry, whether caused by any of the things described in the above subsection (a) or for any other reason, the Sponsors reserve the right, in their sole discretion, to disqualify the entry;
(c) you release Sponsors and each of the Sponsor Entities (individually and/or collectively, the "Released Parties") from any liability whatsoever and waive any and all causes of action, regardless of the form or basis of the claim, related to any claims, costs, injuries, losses, or damages of any kind arising out of, resulting from or otherwise in connection with the Promotion or any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory; and
(d) As a condition of being declared a winner, being awarded and receiving any prize, each potential winner (including all entrants listed and named with the submitting entrant of any particular Movie) will each be required to execute and deliver to Sponsors a signed Affidavit of Eligibility (or, for residents of Canada, a Declaration of Eligibility) and Liability/Publicity Release, which also includes an acceptance of and affirmation of compliance with all the terms and conditions of these Official Rules.
10. Winners List; Official Rules. 11. Miscellaneous. The Promotion and these Official Rules and all materials, documents, affidavits, releases and other agreements and obligations referred to and related to this Promotion shall be governed, construed and interpreted under the laws of the State of New York that apply to contracts made, entered into and wholly performed within the State of New York and the Federal laws of the United States applicable therein. Entrants agree to comply with and be bound by these Official Rules and by the decisions of Sponsors and the judges, which are final and binding in all respects. Sponsors reserve the right to change these Official Rules at any time, in their sole discretion, and, without notice, modify, suspend or cancel the Promotion, in whole or in part, or any entrant's participation in the Promotion should any causes beyond Sponsors’ control or any activity or event affect the administration, security or proper conduct of all or any part of the Promotion or if Sponsors otherwise become (as determined in their sole discretion) incapable of running the Promotion as planned or intended by Sponsors. In the Sponsors’ sole discretion, upon any termination of the Promotion, the Sponsors may have the judges determine the Contest prize winners and/or the Sponsors may draw the Sweepstakes winners, if applicable, from among the eligible entries received up to the date of termination or may employ any other method of awarding prizes as the Sponsors deem appropriate, consistent with applicable law and regulation. 1. Eligibility. You must be a legal resident of Austria, Belgium, Denmark, Finland, France, Germany, Ireland, Luxembourg, Norway, Sweden or the United Kingdom to enter or participate in the Promotion or to be awarded or win any prize. You must also be at least 18 years of age or older at the time of your entry; however, if you are at least 15 years old and a legal resident of Austria, Belgium, France Germany, Luxembourg or the United Kingdom or even if you are 18 years old but are still considered a minor in your country of legal residence (“Minor”), one of your parents or a legal guardian must submit a signed, written statement to us with your entry, confirming that they have read, understand and agree to all of the terms and conditions in these Official Rules, including the fact that such agreement constitutes acceptance of and agreement to comply with and be bound by these Official Rules on behalf of you and themselves. All applicable federal, state and local laws and regulations apply and this Promotion is void where prohibited or restricted by any mandatory provision of any law or regulation. In the event of any dispute or ambiguity as to who has entered or the identity of any entrant, unless the Sponsors disqualify the entry (which we have the right to do in our sole discretion) entries will be deemed to have been submitted by the owner of the email account from which the email was sent.
Contest Entry Period: You may submit your entry for the Contest portion of the
Promotion, which includes your Movie (as described below),
during the “Contest Entry Period” which commences on
(Central European Time or “CET”)
Sweepstakes Entry Period: As described in further detail in Paragraph 4 below, we will
select, designate and make available on the Xfire website, those Movies (as
defined in Paragraph 3 below) we have selected in each category, to be eligible
to win prizes in the Contest. In order to enter the Sweepstakes portion of the
Promotion, during the Movie Voting Period, you must download, view and then
submit your vote for the Movie you believe is the best, in each one or more of
the designated Movie categories, as well as the entry your believe is the Best
Movie Overall. The “Movie Voting Period” begins at CET on
Entrants may submit multiple Movies, but are restricted to only one entry and one prize per category (including the selection as Best Overall Movie) and, for each Movie, entrants must select the category, from the designated categories available, in which that Movie is being entered. Sponsor will not accept as an entry and will disqualify any Movie that has been released publicly prior to the start of the Promotion or that in any way violates these Official Rules. Entrants must include with their Movie submission, the full legal name of each individual who participated or contributed in any way to the submitted Movie, each of those individuals’ physical postal address, each of their email addresses, each of their Xfire user names and the category under which the Movie is submitted for entry into the Contest (“Submitting Information”). Entries consist of the Movie and all of the Submitting Information and entrants can choose one of two methods to submit their Movies as follows:
Method 1: You may submit your Movie on the Internet by following the instructions at: http://www.xfire.com/cms/xf_wow_contest_summer and which allows you to provide a URL to the Movie being entered; or
Method 2: You may submit your Movie by email by attaching the Movie file to an email sent from the submitting Xfire registered users’ email account to: xfirewowmovies@xfire.com. The email entry with the Movie attached must have the following words (and ONLY the following words) in the subject space or line of the email "WoW Summer Movie Contest" and should provide the Submitting Information in he body of the email.
Each Movie must include clear visual graphic displays or audio mentions of Blizzard Entertainment, Inc. and Xfire, Inc. or their logos or distinctive identification and must, at least once at the beginning or at the end of the Movie, feature the Prize Donors' Slides. The official Xfire logo and other official Xfire materials permitted to be used in the Movie for the Contest can be found at: http://www.xfire.com/cms/xf_presskit. The foregoing content and material provided for your use pursuant to the foregoing shall, for purposes of these Official Rules, be considered part of the Scenes as that term is defined above.
Each Movie submission must be submitted in one of the following formats only: ".wmv", ".avi", ".mpg", ".mpeg", ".qt," or ".mov" format. For the Drama, Music/Dance and Comedy categories the file size shall not exceed 100Mb in size or 10 minutes in length. For the Short Feature category the file shall not exceed 25Mb or 2 minutes in length. All text, words, lyrics and other content in the Movie must be in the English language. Any and all music in the Movie must either be the entrant's original musical composition and performance or music from the World of Warcraft game. Movies shall not contain content or material of any kind that violates or is inconsistent with these Official Rules or infringes the rights of any other party, including, any content that contains (or appears to contain), in the Sponsor’s sole opinion and judgment:
o explicitly profane or obscene material;
o endorsement (or condonation) of illegal drug use, alcohol abuse or other illegal activity;
o nudity, profanity or extreme or gratuitous violence;
o any express or implied commercial endorsement;
o any derogatory characterization of any person or group based on age, race, color, gender identity or expression, sexual orientation, religious beliefs, marital status, mental or physical disability, citizenship, creed, national origin, physical appearance, political affiliation, union membership, or other ethical or unlawful factors;
o any violation of these Official Rules or Xfire's Terms and Conditions that apply to Xfire registered users posted at http://www.xfire.com/terms_and_conditions;
o any unauthorized use of copyrighted or proprietary material, including, without limitation, unauthorized use of any trademark, logo or any individual’s name, photograph, voice or likeness; or
o depictions of any conduct, language or other context deemed inappropriate by the Sponsors or any of the judges selected by the Sponsors.
Entering the Sweepstakes: You need to be a registered Xfire user with an Xfire user name to enter. Becoming a registered Xfire member is free and there is no obligation to purchase anything as an Xfire member. Voting will take place during the Movie Voting Period in the Xfire forums under the World of Warcraft Summer Movie Contest section. To enter you simply vote for your favorite Movie in one or more of the designated Movie categories, as well as your vote for the Best Movie Overall, during the Movie Voting Period. Until the Voting Deadline, eligible entrants will be allowed to vote for their favorite Movie within each category, but only one vote is allowed per registered Xfire member in each category. Voting will proceed until the Voting Deadline and the results of the popular Xfire registered user voting will be used to help determine the prize winners of the Contest as described below. Each vote by an eligible entrant represents one entry for that eligible entrant in the Sweepstakes. Voting is identified by user name as a registered Xfire member.
Selection of Contest Winners: Within each Movie category, the Sponsors will evaluate and select five (5) winning Movies, and they will be ranked by the judges in order of their selection as 1st, 2nd, 3rd, 4th and 5th within each category. Selections in each category will be made by a panel of judges selected by the Sponsors and shall be determined by the judges based on the weighted determinations as follows: Xfire forum/popular vote (20%); selections of Blizzard Entertainment, Inc. (40%); and selections of Xfire, Inc. (40%). The judges shall use criteria which includes, but is not limited in their sole judgment and discretion, to the Movies that display the most original, authentic, funny and/or artistic expression within each of the Contest categories and that is based on the World of Warcraft game. In addition, the Grand Prize Winner and those Movies meriting Honorable Mention will be selected by the judges in the same manner. In the event of a tie, the judges shall re-review and re-evaluate the tied entries to determine the ranking or selections. In addition, if any Movie or any entrant submitting a Movie, that is selected as potential winner is determined to be ineligible or is disqualified or unable to accept a prize, Sponsors shall have the right to disqualify that Movie and/or entrant and the Sponsors shall have the right to move each of the other Movies up in rank, if appropriate and/or select another winning Movie, from the pool of remaining eligible entries, in the sole discretion and determination of the Sponsors. Decisions and determinations of the Sponsor shall be binding and conclusive for all purposes in this Promotion.
The entrants responsible for the Movies selected in this manner are the potential prize winners and each will be notified by email within approximately fourteen (14) days after their selection. To be declared the winner within the category and at the level designated by the judges, and to be awarded and claim the applicable prize, potential prize winners must follow the instructions contained in their notification which describe how they must comply with these Official Rules, including the completion of the necessary affidavits and release forms.
Selection of Sweepstakes Winners: The popular vote to select winners will take place in the Xfire
forums, under the World of Warcraft Summer Movie Contest section. The Xfire
forums can be accessed by creating a free Xfire account and becoming an Xfire
member (http://www.xfire.com/download). Each Xfire member, by user name, is entitled to vote for the
Best Movie Overall, as well as their favorite Movie within each category (i.e.,
a maximum of 5 votes if the member votes in all categories). When the voting is
completed and the Voting Deadline has passed, the Sponsors will randomly select
20 potential prize winners drawn from all the votes cast by eligible entrants
during the Movie Voting Period, each of whom, if eligible, will win one of the
Voter Incentive Prizes described below. The drawing for the Voter Incentive
Prizes will be conducted on or about
If any Xfire member selected as potential winner is determined to be ineligible, is disqualified or unable to accept a prize, the Sponsors shall have the right to disqualify that Xfire member from the Sweepstakes and the Sponsors shall have the right to draw another Xfire user name as a potential winner, from the pool of remaining eligible entries. Decisions and determinations of the Sponsor shall be binding and conclusive for all purposes in this Promotion.
5. Prizes. All prize values are expressed in U.S. dollars and all prizes will be awarded. You will be responsible for any taxes imposed by a government on prize awards or winnings. In order to be declared a winner, be awarded and receive a prize, individuals selected as potential prize winners must execute and return to the Sponsors, within the time period required, an affidavit of eligibility and a liability and promotional/publicity release (except to the extent prohibited or otherwise restricted by mandatory provisions of the Law) before they can officially be declared a winner, be awarded and receive their prize. If we are unable to contact and/or notify any potential prize winner within five (5) days after we start attempting to do so or if any prize is returned as undeliverable or is not claimed within fifteen (15) days after notification of being a potential winner, that prize will be forfeited and awarded to an alternate potential winner determined in accordance with these Official Rules. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsors reserve the right to substitute a prize of equal or greater value for any prize. All prizes are awarded by the Sponsors "AS IS" without representation or warranty of any kind, express or implied, from the Sponsor and only the manufacturers’ or distributors’ warranties, if any, will apply to the prizes. In case a prize is not available, you will receive an item comparable in function and value.
(A) Contest Prizes: In the Contest portion of the Promotion, there will be a total of thirty-one (31) prizes awarded: one (1) Grand Prize for the best Movie overall, five (5) prizes, ranging from 1st Prize to 5th Prize, in each of the four designated Movie Categories and ten (10) prizes to Movies that are awarded Honorable Mention. If multiple individuals are involved in the submission of any Movie entry, prize awards will be awarded to the individual Xfire registered user that submitted the winning entry.

(B) Sweepstakes (Voter Incentive) Prizes:
Xfire registered user members who download and view the Movies may submit one vote during the Movie Voting Period for their favorite Movie in each of the designated Movie categories. Although Xfire registered user members can choose to vote in any or all of the designated Movie categories, entrants are only permitted to vote once in each category and receive one entry in the Sweepstakes for each vote. After the Movie Voting Deadline, the names of twenty (20) eligible entrants will be randomly selected from all of the eligible entries received in the Sweepstakes, to win one of the Voter Incentive Prizes described below.
The 20 Sweepstakes winners will each receive a Zboard Keyboard (ARV $50 each). If any entry or Xfire registered user entrant is ineligible or disqualified for any reason, another entrant will be selected for that prize from the pool of remaining eligible entries in the Sweepstakes.
The total ARV of all the prizes to be awarded in the Sweepstakes portion of the Promotion is: $1,000.

6. Sponsor Use of Movies and
Submission Information. By entering the Contest,
you (and your parent or legal guardian,
if applicable) hereby grant each of the Sponsors, jointly and individually, as
well as each of the Sponsor Entities, a royalty-free, perpetual (except in
France where the license applies only for so long as the applicable
intellectual property rights remain applicable) , non-exclusive, irrevocable,
worldwide license and right to reproduce on any materials, represent, display,
directly or indirectly broadcast via any means now existing or later
development (which includes also unknown technologies unless mandatory Law
prohibits a license regarding such unknown technologies) use, exploit in
connection with this Promotion and the World
of Warcraft game and otherwise treat as their own, each Movie and
Submission Information and any other information and materials you submit to
Sponsor in connection with the Contest (the "Entry Materials").
The Entry Materials will not be returned to any entrant and without limiting
the generality of the foregoing, you acknowledge that Sponsors and the Sponsor
Entities shall have the right to use, modify, reproduce, publish, perform,
display on all forms of media, distribute, for an unlimited number of times,
make available to third parties for their use (for instance, but not limited
to, participants in the Sweepstakes who may inter
alia download Entry Materials) make derivative works of, use same in
advertising and promotional material in connection with this Promotion and the World of Warcraft game, in perpetuity
(except in France where the license applies only for so long as the applicable
intellectual property rights remain applicable) and otherwise commercially and
non-commercially exploit the Entry Materials in connection with this Promotion
and the World of Warcraft game, in perpetuity (except in France where the
license applies only for so long as the applicable intellectual property rights
remain applicable) and throughout the universe, in any manner or medium now
existing or hereafter developed (which includes also unknown technologies unless
mandatory Law prohibits a license regarding such unknown technologies), without
notice, attribution (including copyright owner indication) or compensation to
you or any other person or entity. For the avoidance of ambiguity, in

You hereby warrant and represent that by submitting Entry Materials (a) you own all rights to your Entry Materials, except the Scenes, (b) all Entry Materials, except the Scenes, are original works of authorship on your part or the other entrants you have identified as participating or contributing to the creation and production of the Entry Materials, (c) you have not been copied, in whole or in part, from any other work and are not violating, misappropriating or infringing any proprietary, intellectual or industrial property, privacy, publicity or personality or other right (including, without limitation, copyright, trademark or service mark) of any other person, firm or entity, and you are not violating or breaching any law, regulation, agreement or obligation by which you are bound.
8. Collection of Information. The Entry Materials includes Submission Information that involves your providing to us your personally identifiable information and such information will only be used to administer the Promotion and to contact you in the event you are chosen as a potential prize winner as well as in connection with the prize announcement pursuant to paragraph 11. You specifically consent and authorize us to transfer you personal information to the United States and to our suppliers and others that we use to fulfill the prizes or perform obligations related to the Promotion (and only for those purposes) or as otherwise specifically described in these Official Rules or in the affidavit and release and related documentation you will be required to agree to and execute in order to be awarded and receive a prize. The Sponsors will not sell, rent or otherwise transfer any of your personally identifiable information to any non-affiliated third party, nor use such information or allow any of the Sponsor Entities to use, any such information for marketing purposes without your consent. All personal data obtained in connection with the Promotion will be stored pursuant to applicable data protection regulations only for as long as necessary to enable us to perform our obligations under this Promotion, except that personal data you provide to us when you become a registered user and member of Xfire is governed by the terms and conditions that apply to your registration as an Xfire registered user. If we discover any entrant submitting Entry Materials is a resident of the European Union and under the age of fifteen (15) years, in addition to disqualifying the entry, Sponsor will delete, erase and destroy all personally identifiable information that is obtained from such Entry Materials. We reserve the right to display your name, if you are a prize winner, along with any or all of the other prize winners names in connection with this Promotion. Based on applicable Law you may have the right of access to, to modify and/or withdraw your personal data that we collect. 9. General Disclaimer and Releases.
By entering or participating in the Promotion, submitting any Entry Materials and/or by accepting or receiving any prize, you acknowledge, understand and agree that:
(a) The Sponsor Entities shall not be responsible or liable for: (i) any late, lost, misrouted, illegible, imperceptible, unreadable, garbled or distorted or damaged transmissions or entries; (ii) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related delays, malfunctions or failures; (iii) any disruptions, injuries, losses or damages caused by events beyond the control of Sponsors; or (iv) any transmission, printing or typographical errors that may occur or be discovered;
(b) Proof of submission of an entry, does not constitute evidence that the entry was received and if there is any failure, delay or problem with your entry, whether caused by any of the things described in the above subsection (a) or for any other reason, the Sponsors reserve the right, in their sole discretion, to disqualify the entry;
(c) unless prohibited and/or subject to any mandatory restrictions or limitations of the law or regulations that apply to you release Sponsors and each of the Sponsor Entities (individually and/or collectively, the "Released Parties") from any liability and waive any and all causes of action, regardless of the form or basis of the claim, related to any claims, costs, injuries, losses, or damages of any kind arising out of resulting from or otherwise in connection with the Promotion or any prize (including, without limitation, claims, costs, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether under a theory of contract, tort (including slight negligence), warranty or other theory; and
(d) As a condition of being declared a winner, being awarded and receiving any prize, each potential winner (including all entrants listed and named with the submitting entrant of any particular Movie) will each be required to execute and deliver to Sponsors a signed Affidavit of Eligibility and Liability/Publicity Release, which also includes an acceptance of and affirmation of compliance with all the terms and conditions of these Official Rules.

11. Miscellaneous. The Promotion and these Official Rules and all materials, documents, affidavits, releases and other agreements and obligations referred to and related to this Promotion shall be governed, construed and interpreted under the laws of Germany. Entrants agree to comply with and be bound by these Official Rules and by the decisions of Sponsors and the judges, which are final and binding in all respects. Sponsors reserve the right to change these Official Rules at any time, in their sole discretion, and, without notice modify, suspend or cancel the Promotion, in whole or in part, or any entrant's participation in the Promotion should any causes beyond Sponsors’ control or any activity or event affects the administration, security or proper conduct of all or any part of the Promotion or if Sponsors otherwise become (as determined in their sole discretion) incapable of running the Promotion as planned or intended by Sponsors. In the Sponsors’ sole discretion, upon any termination of the Promotion, the Sponsors may have the judges determine the Contest prize winners and/or the Sponsors may draw the Sweepstakes winners, if applicable, from among the eligible entries received up to the date of termination or may employ any other method of awarding prizes as the Sponsors deem appropriate, consistent with applicable law and regulation. Sponsors reserve the right to disqualify, prohibit from entry, participation, voting or otherwise being involved in this Promotion, any persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter or participate in the Promotion or found to be in violation of these Official Rules. Zur Teilnahme am Wettbewerb muss ein Teilnehmer einen Film (gemäß der unten beschriebenen Bedingungen) einreichen. Ein Kauf oder eine Einreichung eines Filmbeitrages ist für die Teilnahme an und für den Gewinn der Verlosung nicht erforderlich. Eine Teilnahme am Wettbewerb hat keine Auswirkung auf die Gewinnchancen bei der Verlosung, die nur von der Anzahl der teilnahmeberechtigten Teilnehmer an der Verlosung abhängt.
Blizzard Entertainment, Inc. und Xfire, Inc. sind die Sponsoren dieses Gewinnspiels und werden in diesen Offiziellen Teilnahmebedingungen zusammen als die „Sponsoren“, „wir“, „uns“ oder „unser“ bezeichnet.
Die Offiziellen Teilnahmebedingungen weichen in den verschiedenen Ländern in bestimmten Aspekten aufgrund von Unterschieden in der Gesetzgebung in den einzelnen Ländern ab. Sie sollten die für Sie geltenden Teilnahmebedingungen gründlich durchlesen, da diese einen Vertrag zwischen Ihnen und uns im Zusammenhang mit diesem Gewinnspiel darstellen.

1. Teilnahmeberechtigung. Teilnahme- und gewinnberechtigt sind alle rechtmäßigen Einwohner von Österreich, Belgien, Dänemark, Finnland, Frankreich, Deutschland, Irland, Luxemburg, Schweden oder dem Vereinigten Königreich. Sie müssen zum Zeitpunkt der Teilnahme mindestens 18 Jahre alt sein oder älter. Eine Teilnahme ist jedoch auch im Alter von mindestens 15 Jahren oder auch im Alter von 18 Jahren - wenn man im Land des Wohnsitzes noch als minderjährig gilt - möglich, wenn man Einwohner von Österreich, Belgien, Frankreich, Deutschland, Luxemburg oder dem Vereinigtem Königreich ist, und zusammen mit dem Wettbewerbsbeitrag eine von den Eltern bzw. Erziehungsberechtigten unterschriebene, schriftliche Erklärung einreicht. In dieser Erklärung muss von den Eltern bzw. Erziehungsberechtigten bestätigt werden, dass sie alle Teilnahmebedingungen gelesen und verstanden haben und diesen auch zustimmen. Mittels dieser Erklärung stimmen Sie für sich sowie für den Minderjährigen der Einhaltung zu diesen Teilnahmebedingungen zu. Auf Anfrage übersenden wir Ihnen das Einwilligungs- und Zustimmungsformular, das Minderjährige ausgefüllt mit ihrem Beitrag einreichen müssen (Die entsprechenden Formulare können unter http://www.xfire.com/cms/xf_blizzard_minor_consent_form angefordert werden.)
Falls Sie Ihren Wohnsitz in Frankreich haben, brauchen Sie, zusätzlich zu anderen Erfordernissen, einen freien Internetzugang oder einen Internet Zugangsplan mit unbegrenzter Nutzung ohne zusätzliche Gebühren oder sonstige Kosten. Beiträge können nur von registrierten Xfire-Nutzern mit einem registrierten Xfire-Benutzernamen eingereicht werden. Eine Anmeldung als Xfire-Nutzer ist kostenlos und auch nicht mit einer Kaufverpflichtung verbunden. Mit Hilfe der Anweisungen auf http://www.xfire.com kann man sich anmelden und registrieren lassen sowie einen Xfire-Benutzernamen einrichten. Direktoren, leitende Angestellte, Partner und Mitarbeiter von den Sponsoren sowie von entsprechenden Tochtergesellschaften, Geschäftspartnern, verbundenen Unternehmen oder anderen entsprechenden Vertretern, Werbepartnern, Preislieferanten, Beratern, Werbeagenturen, einschließlich ihrer Angehörigen oder im gleichen Haushalt lebenden Personen sind von der Teilnahme ausgeschlossen. Die vorgenannten Personen oder Unternehmen werden in diesen Offiziellen Teilnahmebedingungen als „Sponsorengemeinschaft“ bezeichnet.
Wenn Sie aus irgendeinem Grund nicht teilnahmeberechtigt sind, Sie nicht alle Voraussetzungen erfüllen oder Sie (bzw. Ihre Eltern oder Erziehungsberechtigten) den Offiziellen Teilnahmebedingungen nicht zustimmen, sind Sie nicht berechtigt am Gewinnspiel teilzunehmen und zu gewinnen. Sollten Sie trotzdem versuchen, am Gewinnspiel teilzunehmen, können wir Sie jederzeit sofort vom Gewinnspiel ausschließen.
Alle geltenden Bundesgesetze, Ländergesetze und Verordnungen finden Anwendung. Dieses Gewinnspiel ist überall da ungültig, wo es durch zwingende Bestimmung eines Gesetzes oder einer Verordnung verboten oder eingeschränkt ist. Im Falle einer Streitigkeit oder Unklarheit mit Bezug auf die Identität des Gewinnspielteilnehmers wird, wenn die Sponsoren den Teilnehmer nicht vom Gewinnspiel ausschließen (wozu wir nach eigenem Ermessen das Recht haben), angenommen, dass der Besitzer der Email-Adresse, von der aus der Wettbewerbsbeitrag eingereicht worden ist, der Teilnehmer ist.
2. Teilnahmeschluss
Einsendeschluss für den Wettbewerb: Die Wettbewerbsbeiträge als Teil dieses Gewinnspiels, die den Film (wie weiter unten definiert) beinhalten, können während des „Wettbewerbs-Einsendezeitraums“, die am 25. Juli 2006 ab 20.59 Uhr (Central European Time oder “CET“) anfängt und am 25. September 2006 bis 21.00 Uhr CET abläuft („Einsendeschluss“) eingereicht werden. Alle Beiträge müssen zum oder vor Einsendeschluss bei den Sponsoren eingegangen sein (ausschlaggebend ist der Zeitpunkt, der im Computersystem der Sponsoren gespeichert ist), um zur Teilnahme oder zum Gewinn berechtigt zu sein.
Teilnahmeschluss für die Verlosung: Wie unter 4. näher erläutert, werden wir von den eingegangenen Filmen jeweils die Filme (wie unter 3. definiert) für jede Kategorie auswählen, bestimmen sowie auf der Xfire-Website zugänglich machen. Für eine Teilnahme an der Verlosung müssen die Filme während der Abstimmungsphase herunter geladen und angesehen werden sowie eine Stimme für den Ihrer Meinung nach besten Film in einer oder mehreren Kategorien abgegeben werden, sowie für den insgesamt besten Film. Der „Film-Abstimmungszeitraum“ findet zwischen dem 9. October 2006, 20.59 Uhr CET und dem 9. Oktober 2006, 21.00 Uhr CET („Film-Abstimmungsende“) statt. Die Filme können kostenlos herunter geladen und angesehen werden, die Stimmabgabe für die Verlosung ist ebenfalls kostenlos. Teilnahmeberechtigte Teilnehmer können in einer oder in allen Filmkategorien ihre Stimme abgeben, aber dürfen in jeder Kategorie jeweils nur einmal ihre Stimme abgeben.
3. Teilnahme
Teilnahme am Wettbewerb: Zur Teilnahme am Wettbewerb muss der berechtigte Teilnehmer einen digitaler „Film“ einreichen, der Inhalte und Materialien aus dem Videospiel World of Warcraft von Blizzard Entertainment („Szenen“) enthält („Film“). Die Sponsoren räumen Ihnen hiermit ein beschränktes, nicht-exklusives, nicht übertragbares, widerrufbares Nutzungsrecht und Lizenz für diese Szenen ein, einschließlich des Rechts, diese Szenen während des Wettbewerb-Einsendezeitraums und zum Zwecke der Teilnahme am Wettbewerb und der Einreichung des Filmes an die Sponsoren für Ihren Film zu nutzen, abzuändern oder anzupassen. Die Szenen sind und bleiben Eigentum der Sponsoren und deren entsprechenden Lizenzgeber und Lieferanten, Werbepartnern und/oder anderen Personen, Firmen oder Institutionen, die Rechte an diesen Szenen halten und besitzen (einschließlich und ohne Einschränkung der gewerblichen Rechte und der Rechte des geistigen Eigentums), und wir behalten uns alle Rechte, die den Teilnehmern gemäß diesen Teilnahmebedingungen nicht eingeräumt werden, vor. Die sonstigen Elemente und Teile Ihres Filmes, einschließlich des „look and feels“, der Sequenzen und der Struktur, müssen vom dem angemeldeten Teilnehmer oder von mehreren angemeldeten Teilnehmern, wies sich aus der jeweiligen Anmeldung ergeben muss, selbst neu geschaffen sein und ein originär erstelltes Werk darstellen. Sie dürfen die lizenzierten Szenen weder zu kommerziellen noch zu anderen Zwecken verwenden, außer für die Teilnahme am Wettbewerb oder für die persönliche Verwendung.
Teilnehmer können mehrere Filme einreichen, jedoch jeweils nur einen Film pro Kategorie und können auch nur einen Preis pro Kategorie gewinnen (einschließlich dem Preis für die Auswahl des insgesamt besten Films). Für jeden Film müssen die Teilnehmer eine von den zur Auswahl stehenden Kategorien wählen, für den sie ihren Film einreichen wollen. Filme, die schon vor Beginn des Gewinnspiels veröffentlicht wurden oder die auf andere Weise die Teilnahmebedingungen verletzen, werden von der Teilnahme ausgeschlossen. Die Teilnehmer müssen zusammen mit ihrem Film eine Liste mit den vollständigen rechtsgültigen Namen aller Personen einreichen, die auf irgendeine Art und Weise am eingereichten Film mitgearbeitet haben oder beteiligt waren, sowie die Postadresse dieser Personen, Email-Adressen, Xfire-Benutzernamen und die Kategorie, unter der der Film am Wettbewerb teilnehmen soll („Einzureichende Information“). Die Wettbewerbsbeiträge bestehen aus dem Film und der Einzureichenden Information. Die Teilnehmer können zwischen den folgenden zwei Möglichkeiten wählen, wie sie ihre Filme einreichen wollen:
Einreichung der Filme:
Möglichkeit 1: Der Film wird über das Internet eingereicht, Anweisungen hierzu finden Sie auf http://www.xfire.com/cms/xf_wow_contest_summer_form. Dies ermöglicht es, eine URL anzugeben, über die der Film abgerufen werden kann, oder
Möglichkeit 2: Der Film kann per Emailanhang eingereicht werden. Dabei wird der Film als Datei an eine Email angehängt, die von der registrierten Email-Adresse des teilnehmenden Xfire-Nutzers gesendet wird an: xfirewowmovies@xfire.com. Die Email mit der angehängten Filmdatei muss den Betreff „WoW Summer Movie Contest“ (und nur diesen Betreff) haben und sollte die Einzureichende Information im Email-Text enthalten.
Jeder Film muss eine eindeutige visuelle graphische Darstellung oder eine hörbare Erwähnung von Blizzard Entertainment, Inc. und Xfire, Inc. oder deren Logos oder charakterisierende Merkmale enthalten, und muss zumindest einmal am Anfang oder am Ende des Films eine der folgenden Bilder beinhalten: Schwarzes Hintergrundbild. Das offizielle Xfire-Logo und andere offizielle Xfire-Materialien, die im Wettbewerbsfilm benutzt werden dürfen, finden Sie auf: http://www.xfire.com/cms/xf_presskit. Die obigen Inhalte und Materialien, die Sie gemäß dem Vorgenannten für den in den Teilnahmebedingungen beschriebenen Zweck verwenden dürfen, werden als Teil der oben definierten Szenen erachtet.
Die Filme müssen in einem der folgenden Formate eingereicht werden: „.wmv“, „.avi“, „.mpg“,“.mpeg“, „.qt“ oder „.mov“. Für die Kategorien Drama, Musik/Tanz und Comedy sollte die Datei höchstens 100 Mb groß oder höchstens 10 Minuten lang sein. Für die Kategorie Kurzfilm sollte die Datei höchstens 25 Mb groß oder 2 Minuten lang sein. Alle Liedtexte, gesprochenen Texte und andere Inhalte des Filmes müssen auf Englisch sein. Jegliche im Film verwendete Musik muss entweder vom Teilnehmer selbst komponiert und eingespielt oder Musik aus dem Spiel World of Warcraft sein. Die Filme dürfen keine Inhalte oder Materialien enthalten, die den Teilnahmebedingungen entgegenstehen oder die Rechte Dritter verletzen. Hierzu gehören auch Inhalte, die nach Meinung und Ermessen der Sponsoren Folgendes enthalten (oder scheinbar enthalten):
- deutlich anstößiges oder obszönes Material;
- Gutheißung (oder Billigung) von illegalen Drogenmissbrauch, Alkoholmissbrauch oder anderen illegalen Aktivitäten;
- Nacktheit, Obszönitäten, extreme oder unnötige Gewalt;
- jegliche Art von ausdrücklicher oder implizierter Werbung;
- jegliche Art von Diskriminierung einer Person oder Gruppe aufgrund von Alter, ethnischer Herkunft, Hautfarbe, Geschlecht, sexueller Orientierung, Religion, Familienverhältnissen, geistige oder physische Fähigkeiten, Staatsangehörigkeit, Glaubenszugehörigkeit, Herkunft, physisches Erscheinungsbild, politische Gesinnung, Mitgliedschaft in einer Gewerkschaft oder aus anderen ethischen oder gesetzeswidrigen Gründen;
- jegliche Verletzung der Offiziellen Teilnahmebedingungen oder der Allgemeinen Geschäftsbedingungen von Xfire, die für alle registrierten Xfire-Nutzer gelten und unter http://www.xfire.com/terms_and_conditions/ eingesehen werden können;
- jegliche unerlaubte Verwendung von urheber- oder eigentumsrechtlich geschützten Materialien, einschließlich und ohne Einschränkung von unerlaubter Verwendung von Marken, Logos oder Namen, Fotografien, Stimmen oder Porträts von Personen; oder
- Darstellungen von Verhaltensweisen, Sprache oder anderen Inhalten, die die Sponsoren oder eines der von den Sponsoren ausgewählten Jurymitglieder als unangebracht erachten.
Teilnahme an der Verlosung: Zur Teilnahme an der Verlosung muss man als Xfire-Nutzer mit einem Xfire-Benutzernamen registriert sein. Die Anmeldung bei Xfire ist kostenlos und auch nicht mit einer Kaufverpflichtung verbunden. Die Abstimmung wird während der Abstimmungsphase stattfinden und zwar in den Xfire-Foren im Bereich World of Warcraft Summer Movie Contest. Um an der Verlosung teilzunehmen stimmen Sie einfach für Ihren Favoriten-Film in einer oder mehreren Filmkategorien und/oder für den insgesamt besten Film während des Film-Abstimmungszeitraums ab. Stimmen für Ihren Favoriten in jeder Kategorie können Sie bis zum Film-Abstimmungsende abgeben, aber pro Kategorie kann nur eine Stimme pro Xfire-Nutzer abgegeben werden. Die Abstimmung läuft bis zum Film-Abstimmungsende und die Ergebnisse der von Xfire-Nutzern abgegebenen Stimmen werden zur Ermittlung der Siegers des Wettbewerbs (wie unten beschrieben) beitragen. Jede von einem teilnahmeberechtigten Teilnehmer abgegebene Stimme stellt ein Los für die Verlosung dar. Die Stimmabgabe erfolgt über den registrierten Benutzernamen.
4. Auswahl der Gewinner
Auswahl der Wettbewerbsgewinner: In jeder Filmkategorie werden die Sponsoren fünf (5) Sieger-Filme bewerten und auswählen. Diese werden von der Jury in jeder Kategorie in der Reihenfolge 1. bis 5. Platz aufgelistet. Die Auswahl wird von einer von den Sponsoren ausgewählten Jury getroffen. Ausschlaggebend für die Entscheidung der Jury sind mit den in Klammern angegebenen Prozenten: die im Xfire-Forum abgegebenen Stimmen (20 %); die von Blizzard Entertainment, Inc. getroffene Auswahl (40 %); und die von Xfire, Inc. getroffene Auswahl (40 %). Die Jury soll die auf dem Spiel World of Warcraft basierenden Filme in jeder Kategorie unter anderem aber nicht ausschließlich nach ihrer Originalität, Authentizität, Komik und ihrem künstlerischen Ausdruck bewerten. Zusätzlich werden die Gewinner des Hauptpreises und die Filme, die ehrenhafte Erwähnung verdienen, auf die gleiche Weise von der Jury ausgewählt. Im Falle eines Gleichstands wird die Jury die betreffenden gleich bewerteten Beiträge noch einmal ansehen und bewerten und dann die Reihenfolge oder Auswahl neu treffen. Außerdem haben die Sponsoren das Recht, einen Film und/oder den Teilnehmer vom Wettbewerb auszuschließen, wenn der Film oder der Teilnehmer, der als potenzieller Gewinner ausgewählt wurde, nicht dazu berechtigt oder nicht in der Lage ist, den Preis entgegen zu nehmen. In einem solchen Falle haben die Sponsoren weiterhin das Recht, die anderen Filme jeweils einen Platz nach oben zu verschieben und falls nötig nach eigenem Ermessen einen anderen Siegerfilm aus den übrigen teilnahmeberechtigten Beiträgen auszuwählen. Die Entscheidungen und Festlegungen der Sponsoren sind für alle Zwecke des Gewinnspiels bindend und abschließend.
Die für die auf diese Art und Weise der für die ausgewählten Siegerfilme verantwortlichen Teilnehmer sind die potenziellen Gewinner der Preise und alle potenziellen Gewinner werden per Email innerhalb von ungefähr 14 Tagen nach der Auswahl benachrichtigt. Um zum Gewinner auf dem von der Jury festgelegten Platz und in der Kategorie erklärt zu werden, und den entsprechenden Preis zu erhalten, müssen die potenziellen Gewinner den Anweisungen folgen, die sie zusammen mit der Benachrichtigung erhalten und die beschreiben, wie sie die Teilnahmebedingungen erfüllen müssen und wie sie die erforderlichen beeidigten Erklärungen und Freistellungserklärungen auszufüllen haben.
Auswahl der Verlosungsgewinner: Die Abstimmung für den Wettbewerb findet in den Xfire-Foren im Bereich World of Warcraft Summer Movie Contest statt. Zugang zu den Xfire Foren erhält man, indem ein kostenloses Xfire-Konto angelegt wird (http://xfire.com/download/) und man Xfire Mitglied wird. Jedes Xfire-Mitglied kann seine Stimme unter dem Benutzernamen für den insgesamt besten Film abgeben, sowie für den besten Film in jeder einzelnen Kategorie (d. h. jedes Mitglied kann maximal 5 Stimmen abgeben, wenn das Mitglied in allen Kategorien abstimmt). Nach Beendigung der Abstimmung und nach dem Film-Abstimmungsende werden die Sponsoren nach dem Zufallsprinzip 20 potenzielle Gewinner aus allen während des Film-Abstimmungszeitraums abgegebenen Stimmen von berechtigten Teilnehmern ziehen. Jeder dieser Xfire-Nutzer, die ausgewählt worden sind, erhält, soweit er während des Film-Abstimmungszeitraums teilnahmeberechtigt war, einen der unten beschriebenen Verlosungspreise. Die Verlosung dieser Preise wird am oder um den 23. Oktober 2006 durchgeführt werden und die ausgewählten potenziellen Preisgewinner werden per Email benachrichtigt.
Falls sich eines der als potenzieller Gewinner ausgewählten Xfire-Mitglieder als nicht teilnahmeberechtigt herausstellt, oder nicht in der Lage ist, den Preis entgegen zu nehmen, haben die Sponsoren das Recht, dieses Xfire-Mitglied von der Verlosung auszuschließen. Außerdem haben die Sponsoren in einem solchen Fall das Recht, einen anderen Xfire-Benutzernamen als potenziellen Gewinner aus den übrigen teilnahmeberechtigten Teilnehmern zu ziehen. Die Entscheidungen und Festlegungen der Sponsoren sind für alle Zwecke dieses Gewinnspiels bindend und abschließend.
5. Preise. Alle Werte der Preise werden in US-Dollar angegeben und alle Preise werden vergeben. Im Falle eines Gewinns sind Sie allein für eventuell anfallende Steuern auf die gewonnenen Preise verantwortlich. Um als Gewinner erklärt zu werden und um den Preis zu erhalten, müssen die als potenziellen Gewinner ausgewählten Personen innerhalb des angegebenen Zeitraums eine Berechtigungserklärung, eine Haftungsausschlusserklärung und Werbeausschlusserklärung (es sei denn, diese sind nach zwingend anwendbaren Recht untersagt oder anderweitig eingeschränkt) ausfüllen und an die Sponsoren schicken, bevor sie offiziell zu einem Gewinner erklärt werden und einen Preis erhalten können. Wenn wir potenzielle Gewinner innerhalb von fünf (5) Tagen nicht kontaktieren und/oder benachrichtigen können, oder wenn ein Preis als unzustellbar zurück gesendet wird oder innerhalb von 15 Tagen nach Benachrichtigung nicht eingefordert wird, verfällt der Preis und wird einem anderen gemäß den Teilnahmebedingungen zu bestimmenden potenziellen Gewinner zugesprochen. Preise sind nicht übertragbar. Ein Austausch oder Umtausch (auch gegen Barauszahlung) jeglicher Preise ist untersagt. Die Sponsoren behalten sich jedoch das Recht vor, Preise mit anderen, gleichwertigen oder höherwertigen Preisen auszutauschen. Alle Preise werden von den Sponsoren „in der vorliegenden Form“ ohne ausdrückliche oder implizierte Haftung oder Garantie seitens der Sponsoren vergeben. Wenn überhaupt gelten nur die Garantien der Hersteller bzw. Händler für die Preise. Falls ein Preis nicht verfügbar sein sollte, erhalten Sie einen in Funktion und Wert ähnlichen Preis.
(A) Wettbewerbspreise: Für den Wettbewerb werden insgesamt einunddreißig (31) Preise vergeben: ein (1) Hauptgewinn für den insgesamt besten Film, fünf (5) Preise (1. bis 5. Platz) in jeder der vier festgelegten Filmkategorien, und zehn (10) Preise werden an Filme vergeben, die eine ehrenhafte Erwähnung verdienen. Falls mehrere Personen an einem eingereichten Film beteiligt sind, wird der Preis an die Person vergeben, die den Gewinnerbeitrag mit seinem eigenen Xfire-Benutzernamen eingereicht hat.

Preise für Filme, die eine ehrenhafte Erwähnung verdienen
Die 10 Filme, die nach Meinung der Jury eine ehrenhafte Erwähnung verdienen, erhalten jeweils ein Zboard Keyboard (ARV je $50, insgesamt ARV $500).
ARV insgesamt: Die für den Wettbewerb zu vergebenden Preise haben einen insgesamt einen ARV von $22.460.
(B) Preise in der Verlosung:
Registrierte Xfire-Nutzer, die sich die Filme herunterladen und ansehen, können während des Film-Abstimmungszeitraums je eine Stimme für den ihrer Meinung nach besten Film in jeder Kategorie abgeben. Obwohl die registrierten Xfire-Nutzer in einer oder in allen festgelegten Kategorien abstimmen kann, darf jeder Nutzer pro Kategorie nur eine Stimme abgeben und pro Stimme auch nur ein Los für die Verlosung erhalten. Nach dem Film-Abstimmungsende werden die Namen von 20 teilnahmeberechtigten Teilnehmern aus dem Lostopf nach dem Zufallsprinzip gezogen, die einen der Verlosungspreise wie unten beschrieben gewinnen.
Die 20 Gewinner erhalten jeweils ein Zboard Keyboard (ARV je $50). Sollte ein Teilnehmer oder registrierter Xfire-Nutzer aus irgendeinem Grund nicht gewinnberechtigt sein, wird ein anderer Teilnehmer aus den übrigen Losen für diesen Gewinn gezogen.
Die in der Verlosung zu vergebenden Preise haben insgesamt einen ARV von $1.000.
Die im gesamten Gewinnspiel (Wettbewerb und Verlosung) zu vergebenden Preise haben insgesamt einen ARV von $23.460.
6. Verwendung der Filme und eingereichten Informationen seitens der Sponsoren. Durch die Teilnahme am Wettbewerb gewähren Sie (oder gegebenenfalls Ihre Eltern oder Erziehungsberechtigten) den Sponsoren und der Sponsorengemeinschaft eine unentgeltliche, ewige (mit Ausnahme von Teilnehmern aus Frankreich, wo die Lizenz nur für die Dauer des Bestehens der gewerblichen Schutzrechte eingeräumt wird), nicht-exklusive, unwiderrufbare, weltweite Lizenz und das Recht, gemeinsam oder einzeln, jeden Film und alle eingereichten Informationen sowie alle gegenüber dem Sponsor sonstig zur Verfügung gestellten Informationen und Materialien im Zusammenhang mit dem Wettbewerb („Wettbewerbsmaterialien“) in jeder Form zu reproduzieren, wiederzugeben, direkt oder indirekt über bereits bestehende oder in der Zukunft entwickelte Medien auszustrahlen (dies schließt alle unbekannten Technologien ein, außer zwingende Gesetze verbieten eine Lizenzierung hinsichtlich solcher unbekannten Technologien), zu gebrauchen, und im Zusammenhang mit diesem Gewinnspiel und dem Spiel World of Warcraft zu verwerten, und als eigenes zu verwenden. Die Wettbewerbsmaterialien werden dem Teilnehmer nicht zurück gesendet und ohne die allgemeine Gültigkeit des Vorgesagten zu beschränken erkennen Sie an, dass die Sponsoren und Sponsorengemeinschaft das Recht haben, die Wettbewerbsmaterialien zu verwenden, zu modifizieren, zu vervielfältigen, zu veröffentlichen, vorzuführen, in jeglichem Medium wiederzugeben, zu verteilen, beliebig oft Dritten zur Verwendung zur Verfügung zu stellen (z. B. aber nicht ausschließlich den Teilnehmern an der Verlosung, die unter anderem die Wettbewerbsmaterialien herunter laden können), diese mit anderen Werken zu verbinden, in Werbematerialien im Bezug auf dieses Gewinnspiel und das Spiel World of Warcraft zu verwenden, diese dauerhaft (mit Ausnahme von Teilnehmern aus Frankreich, wo die Lizenz nur für die Dauer des Bestehens der gewerblichen Schutzrechte eingeräumt wird) kommerziell und nicht kommerziell die Wettbewerbsmaterialien im Zusammenhang mit diesem Gewinnspiel and dem World of Warcraft Spiel zu verwerten, dauerhaft (mit Ausnahme von Teilnehmern aus Frankreich, wo die Lizenz nur für die Dauer des Bestehens der gewerblichen Schutzrechte eingeräumt wird) und weltweit in jeglicher Art und Weise und auf jeglichem Medium, das derzeit existiert oder hiernach entwickelt wird (dies schließt alle unbekannten Technologien ein, außer zwingende Gesetze verbieten eine Lizenzierung hinsichtlich solcher unbekannten Technologien) zu verwerten. Eine Benachrichtigung Ihrerseits ist diesbezüglich nicht erforderlich; ferner steht Ihnen kein Ausgleichsanspruch oder sonstige Anerkennung (z.B. Urhebernennung) zu. Zur Vermeidung von Unklarheiten, in Frankreich sowie in anderen Ländern mit vergleichbaren Gesetzen gelten die vorgenannt als „dauerhaft“ oder „ewigen“ bezeichneten Rechte zeitlich nur solange, wie gewerbliche Schutzrechte nach anwendbarem Recht eingeräumt werden. Sie stimmen zu, alle von den Sponsoren in angemessener Weise angeforderten Maßnahmen (einschließlich der Abgabe von Erklärungen sowie Ausfertigung von Dokumente) auf Kosten der Sponsoren zu ergreifen, um die unter 6. beschriebenen Rechte der Sponsoren zu erfüllen, zu erfassen, zu vervollständigen oder zu bestätigen. Hiermit stimmen Sie zu, dass Sie den für den Wettbewerb eingereichten Film zu keinem Zeitpunkt während oder nach dem Gewinnspiel kommerziell verwerten oder Szenen aus einem solchen Film zu einem anderen Zweck als in den Teilnahmebedingungen angegeben verwenden. Weiterhin stimmen Sie zu, den Film/die Filme nicht zu nicht-kommerziellen oder persönlichen Zwecken ins Internet zu stellen oder zu verteilen, und den Sponsoren die exklusiven Rechte zur Wiedergabe, Vorführung, Werbung, Verwendung und Verteilung des Films für einen Zeitraum von 6 Wochen beginnend ab Datum der Vergabe aller Preise einzuräumen und den Sponsoren eine Exklusivität auf die oben genannten Rechte zu geben, einschließlich und ohne Einschränkung der Rechte, den eingereichten Film für einen Zeitraum von 6 Wochen ab dem Datum der Vergabe aller Preise beginnend wiederzugeben, vorzuführen, zu bewerben, zu verwenden und zu verteilen. Auf Anfrage werden wir Ihnen dieses Datum mitteilen.
7. Eigenarbeit. Mit der Einreichung Ihrer Wettbewerbsmaterialien gewährleisten und garantieren Sie, dass alle Wettbewerbsmaterialien, außer den Szenen, die originäre Leistungen Ihrerseits oder anderer Teilnehmer sind, die nach Ihren Angaben bei der Schaffung und Erstellung der Wettbewerbsmaterialien beteiligt waren, (c) Sie keine anderen Werke vollständig oder in Teilen für Ihre Arbeit verwendet haben und auch sonst keine Eigentumsrechte, gewerblichen Schutz- oder Leistungsrechte, Datenschutz-, Öffentlichkeits- oder Persönlichkeitsrechte oder andere Rechte (einschließlich und ohne Einschränkung von Urheberrechten, Marken und Dienstleistungsmarken) von anderen Personen, Unternehmen oder Institutionen verletzen, sich widerrechtlich aneignen oder beeinträchtigen, und Sie keine Gesetze, Verordnungen, Verträge oder Verpflichtungen verletzen, an die Sie gebunden sind.
8. Erfassung von Informationen. Die Wettbewerbsmaterialien enthalten die mit dem Film eingereichten Informationen, d. h. die zur Identifizierung Ihrer Person notwendigen Daten. Diese Informationen werden nur für die Durchführung des Gewinnspiels bzw. zur Veröffentlichung bei der Annahme des Preises nach Ziffer 11 verwendet, und um Sie im Falle eines möglichen Gewinns zu kontaktieren. Sie stimmen insbesondere zu und geben uns die Befugnis, dass ihre persönlichen Daten in die USA weitergeleitet werden und an unsere Lieferanten und andere, die an der Preisvergabe oder der Erfüllung anderer Verpflichtungen im Zusammenhang mit dem Gewinnspiel (und nur für diese Zwecke) beteiligt sind, oder wie in den Teilnahmebedingungen spezifisch beschrieben oder in Formularen und Erklärungen und ähnlichen Dokumenten, denen Sie zustimmen und ausfüllen müssen, um einen Preis zu erhalten, gegeben werden können. Die Sponsoren werden Ihre persönlichen Daten weder verkaufen, vermieten, auf andere Weise an nicht-verbundene Dritte übertragen, noch anderweitig verwenden oder der Sponsorengemeinschaft erlauben, die Informationen ohne ihre Zustimmung für Marketingzwecke zu verwenden. Alle in Verbindung mit dem Gewinnspiel erhaltenen persönlichen Daten werden gemäß den anwendbaren Datenschutzgesetzen gespeichert, und zwar nur so lange wie es nötig ist, um es uns zu ermöglichen unseren Pflichten im Zusammenhang mit dem Gewinnspiel nachzukommen. Davon ausgenommen sind die persönlichen Daten, die zur Anmeldung als Benutzer und Mitglied von Xfire benötigt werden und die den für die Xfire-Anmeldung geltenden Allgemeinen Geschäftsbedingungen unterliegen. Falls wir herausfinden, dass ein Teilnehmer, der Wettbewerbsmaterialien einreicht, ein Einwohner der Europäischen Union ist und unter 15 Jahre alt ist, werden wir zusätzlich zum Ausschluss aus dem Wettbewerb alle durch die Wettbewerbsmaterialien erhaltenen persönlichen Daten löschen und zerstören. Wir behalten uns das Recht vor, Ihren Namen im Falle eines Gewinnes zusammen mit den anderen Gewinnernamen im Zusammenhang mit dem Gewinnspiel zu veröffentlichen. Auf der Grundlage des anwendbaren Rechts haben Sie ferner das Recht auf Zugang zu Ihren persönlichen Daten, das Recht diese abzuändern oder vollständig zurückzunehmen. 9. Haftungsausschluss. Durch die Teilnahme am Gewinnspiel, durch die Übermittelung von Wettbewerbsmaterialien und/oder durch die Annahme oder den Erhalt eines Preises, erkennen Sie an, verstehen und stimmen Sie dem Folgendem zu:
(a) Die Sponsorengemeinschaft ist nicht verantwortlich oder haftbar für: (i) verspätete, verloren gegangene, fehlgeleitete, unleserliche, kaum zu erkennende, verstümmelte, verzehrte oder beschädigte Übertragungen oder Beiträge; (ii) Verzögerungen, Fehlfunktionen oder Ausfälle, die durch Telefon-, Elektronik-, Hardware-, Software-, Netzwerk-, Internet- oder andere Computer- oder Kommunikationsprobleme verursacht werden; (iii) Unterbrechungen, Ausfälle, Verluste oder Beschädigungen, die durch Ereignisse hervorgerufen werden, die nicht in der Macht der Sponsoren stehen; oder (iv) Übertragungs-, Druck- oder Schreibfehler, die auftreten oder entdeckt werden;
(b) Eine Bestätigung der Einreichung eines Beitrags ist nicht Beweis für den Erhalt eines Beitrags. Im Falle von Ausfällen, Verzögerungen oder Problemen mit Ihrem Beitrag, ob durch die in (a) beschriebenen Gründe oder aus anderen Gründen verursacht, behalten sich die Sponsoren das Recht vor, den Beitrag aus dem Wettbewerb auszuschließen;
(c) Sie stellen die Sponsoren und die Sponsorengemeinschaft (einzeln und/oder gemeinsam, die „Freigestellten Parteien“) von jeglicher Haftung frei und Sie verzichten auf alle Klagegründe, ungeachtet der Form und Grundlage der Forderungen, in Bezug auf alle Forderungen, Kosten, Ausfälle, Verluste oder Schäden jeglicher Art, die entstehen durch oder die Folge sind von oder in sonstiger Verbindung stehen mit dem Gewinnspiel oder einem Preis (einschließlich und ohne Einschränkung aller Forderungen, Kosten, Schäden an oder Zerstörung von Eigentum, Persönlichkeits- und Datenschutzrechten, Verleumdung oder Darstellung in falschem Licht, unabhängig von der Anspruchsgrundlage, d.h. einschließlich aus vertraglichen oder deliktischen Anspruchsgrundlagen (soweit nur leichte Fahrlässigkeit vorliegt) oder Gewährleistung. Sollte diese Freistellung aufgrund von für Sie zwingend geltenden Gesetze oder Verordnungen untersagt oder eingeschränkt sein, findet diese Klausel insoweit keine Anwendung.
(d) Als Bedingung für den Gewinn und den Erhalt eines Preises muss jeder potenzielle Gewinner (einschließlich aller bei der Einreichung des Beitrags genannten Teilnehmer, die an diesem bestimmten Film mitgearbeitet haben) eine unterzeichnete Berechtigungserklärung und Freistellungserklärung ausfüllen und an die Sponsoren schicken, die auch eine Zustimmung zu und Anerkennung dieser Teilnahmebedingungen beinhaltet.
10. Gewinnerlisten; Teilnahmebedingungen. Für eine Kopie der Gewinnerliste schicken Sie einen frankierten Rückumschlag zwischen dem 27. October 2006 und dem 31. Dezember 2006 an die folgende Adresse: „Blizzard Xfire World of Warcraft Summer Movie Contest“ – Winners List Request, c/o Blizzard Entertainment, P.O. Box 18979, Irvine, CA 92612, USA. Eine Kopie der Teilnahmebedingungen finden Sie unter http://www.xfire.com/cms/xf_wow_contest_summer oder senden Sie einen frankierten Rückumschlag an: „Blizzard World of Warcraft Summer Movie Promotion“ – Official Rules Request, c/o Blizzard Entertainment, P.O. Box 18979, Irvine, CA 92612, USA. Teilnehmer aus Frankreich können etwaige Postgebühren in normaler Höhe mittels schriftlicher Aufforderung an vorgenannte Adresse zurückverlangen. Zusätzlich wird darauf hingewiesen, dass die Teilnahmebedingungen bei Herrn Jean-Louis Hauguel, huissier, 14 Rue du Faubourg Saint Honore, 75008 Paris hinterlegt sind.
11. Verschiedenes. Das Gewinnspiel und diese offiziellen Teilnahmebedingungen sowie alle Materialen, Dokumente, Versicherungen, Veröffentlichungen und andere Vereinbarungen und Verpflichtungen, auf die in diesem Gewinnspiel Bezug genommen wird und die damit im Zusammenhang stehen, sind nach geltendem Recht der Bundesrepublik Deutschland geregelt, auszulegen und zu interpretieren. Die Teilnehmer verpflichten sich, diesen offiziellen Teilnahmebedingungen sowie den Entscheidungen der Sponsoren und der Jury, die in jeder Hinsicht abschließend und bindend sind, zu entsprechen und diese als bindend anzuerkennen. Die Sponsoren behalten sich das Recht vor, die Teilnahmebedingungen jederzeit in ihrem eigenen Ermessen zu ändern und ohne vorherige Benachrichtigung, die Teilnahmebedingungen oder einen Wettbewerbsbeitrag teilweise oder im Ganzen abzuändern, aufzuheben oder für ungültig zu erklären, sollten irgendwelche Gründe außerhalb der Kontrolle der Sponsoren oder Aktivitäten und Ereignisse auftreten, die Verwaltung, Sicherheit und richtige Durchführung des Gewinnspiels oder Teile davon beeinträchtigen, oder wenn die Sponsoren auf andere (nach ihrem eigenen Ermessen festgelegten) Weise nicht in der Lage sind, das Gewinnspiel wie von den Sponsoren geplant oder beabsichtigt durchzuführen. Sollte das Gewinnspiel nach Ermessen der Sponsoren vorzeitig beendet werden, haben die Sponsoren das Recht, die Jury die Gewinner des Wettbewerbs aus den bis zum Zeitpunkt der Beendigung eingegangenen Beiträgen auswählen zu lassen und/oder die Gewinner der Verlosung aus den bis zum Zeitpunkt der Beendigung eingegangen Stimmen zu ziehen, oder die Gewinnvergabe auf andere ihrer Meinung nach angemessene, gesetzeskonforme Weise durchzuführen. Teilnehmer, die gegen diese Teilnahmebedingungen verstoßen, das Gewinnspiel manipulieren oder sonstiges Verhalten aufweisen, das sich zum Schaden der Sponsoren, des Gewinnspiels oder anderen Teilnehmern (jeder Fall wird nach Ermessen der Sponsoren entschieden) auswirkt, können aus dem Wettbewerb ausgeschlossen werden, und verletzen durch ihr Verhalten womöglich Gesetze, Verordnungen oder internationale Verträge und werden daher möglicherweise rechtlich verfolgt. Die Sponsoren behalten sich das Recht vor, Personen, deren Berechtigung angezweifelt wird oder die bereits ausgeschlossen worden sind oder auf andere Weise nicht teilnahmeberechtigt sind oder diese Teilnahmebedingungen verletzen, aus dem Wettbewerb auszuschließen oder ihnen die Teilnahme (Wettbewerb und/oder Verlosung) zu verbieten. Ohne die Voraussetzungen oder Verpflichtungen aus abzugebenden Erklärungen, Zusicherungen oder Freistellungen einzuschränken und nur in dem Falle, dass dies nicht den gültigen Gesetzen entgegen steht, stellt die Annahme eines Preises die Erlaubnis für die Sponsoren und die Sponsorengemeinschaft dar, Namen, Foto, Porträt, Aussagen, biographische Informationen, Stimme, Stadt und Bundesland des jeweiligen Gewinners (oder der Gewinner, wenn mehrere Personen beteiligt sind) weltweit und in allen bestehenden und in der Zukunft entwickelten Medienformen dauerhaft (mit Ausnahme von Frankreich, wo eine Lizenz nur für die Schutzdauer der gewerblichen Schutzrechte eingeräumt wird), ohne Benachrichtigung, Nennung, Rechenschaft oder Entgelt jeglicher Art zu verwenden.

Si votre résidence légale se trouve en France, vous devez, en plus des autres obligations d’éligibilité, déjà disposer d’un libre accès à l’Internet ou d’un abonnement Internet avec usage illimité afin qu’il n’y ait pas de coût additionnel sur la base du temps passé ou de toutes autres modalités d’utilisation. Si, pour une raison ou pour une autre, vous n’êtes pas éligible, si vous ne satisfaisez pas à tous les critères, ou vous (ou, le cas échéant, votre parent ou gardien légal) n’êtes pas d’accord avec ce Règlement Officiel, alors vous êtes n’êtes pas autorisé à vous inscrire ni à participer et vous n’êtes pas autorisé à gagner. Si toutefois vous participiez à la promotion ou tentiez de le faire, nous pourrions vous disqualifier immédiatement à tout moment.
Toutes les lois et réglementations fédérales, nationales ou locales s’appliquent de plein droit et la présente Promotion sera nulle et non avenue quand elle se trouve interdite ou restreinte par toute stipulation d’ordre public d’une quelconque loi ou réglementation. En cas de litige ou d’ambiguïté sur une inscription ou sur l’identité d’un inscrit, à moins que les Sponsors ne disqualifient l’inscription (ce que nous avons le droit de faire à notre seule discrétion), les inscriptions seront jugées avoir été soumises par le propriétaire du compte email d’où l’email a été envoyé.
2. Périodes d’Inscription.
Périodes d’Inscription au Concours: Vous devez soumettre vos inscriptions à la partie Concours de la Promotion, y compris votre Film (voir description ci-dessous), pendant la “Période d’Inscription au Concours” laquelle débutera à 20:59 (Heure d’Europe Centrale ou “CET”) le 25 Juillet, 2006 et prendra fin à 21:00:00 le 25 Septembre 2006 (“Date Limite du Concours”).Toutes les inscriptions devront être reçues par les Sponsors, à savoir enregistrées et visibles dans les systèmes informatiques du Sponsor, à ou avant la Date Limite du Concours afin de pouvoir être dûment inscrit, participer ou gagner un prix.
Périodes d’Inscription au Tirage : Comme décrit de manière plus détaillée dans le Paragraphe 4 ci-dessous, nous sélectionnerons, désignerons et rendrons accessibles sur le site web Xfire, les Films (tel que ce terme est défini dans le Paragraphe 3 ci-dessous) que nous avons sélectionnés dans chaque catégorie, susceptibles de gagner un prix du Concours. Pour s’inscrire au Tirage de la Promotion, pendant la Période de Vote sur les Films, vous devez télécharger, visionner et ensuite soumettre votre vote pour le Film que vous pensez être le meilleur dans une ou plusieurs catégories de Films désignées, ainsi que celui que vous pensez être le Meilleur Film Toutes Catégories. La “Période de Vote sur les Films” débute à 20:59 CET le 9 Octobre, 2006 et prend fin à 21:00:00 CET le 23 Octobre, 2006 (“Date Limite de Vote sur les Films”). Le téléchargement et le visionnage des Films sont gratuits ainsi que le vote dans le cadre du Tirage de la Promotion. Les inscrits éligibles peuvent voter dans une ou toutes les catégories de Films, mais n’ont droit qu’à un seul vote par catégorie de Films.
3. Comment s’inscrire.
Inscription au Concours: Pour s’inscrire au Concours, les participants éligibles doivent soumettre un “film” numérique qui utilise du contenu et du matériel (“Scènes”) enregistré à partir du jeu de Blizzard Entertainment World of Warcraft (chacun, un « Film »). Par les présentes les Sponsors vous autorisent et vous accordent un droit et une licence restreints, non exclusifs, non transférables et révocables, afin d’utiliser ces Scènes, y compris le droit de créer des oeuvres dérivées, de transformer ou d’adapter ces Scènes dans votre Film dans le but de soumettre le Film aux Sponsors, pendant la durée de la Période d’Inscription au Concours, en rapport avec votre participation au Concours. Les Scènes sont et resteront la propriété des Sponsors ou de leurs concédants respectifs, fournisseurs, partenaires promotionnels, et/ou toute autre personne, sociétés ou entité qui en détiennent et possèdent les droits (y compris, sans limitation, les droits de propriété intellectuelle ou industrielle) et nous nous réservons tous les droits qui ne sont pas spécifiquement accordés par ce Règlement Officiel aux candidats inscrits. Toutefois, les autres éléments et parties de votre Film, y compris le rendu ainsi que l’ordre et la structure, doivent être une création nouvelle, et une oeuvre originale doit être formée et créée par une ou plusieurs des personnes inscrites et participantes citées et apparaissant dans votre soumission. Vous ne pouvez pas utiliser les Scènes sous licence pour tout usage, commercial ou non, autre que la présentation de votre Film en temps que participation au Concours ou pour votre usage strictement personnel.
Les candidats inscrits peuvent soumettre plusieurs Films, mais sont restreints à un Film et un prix par catégorie (y compris pour la sélection du Meilleur Film Toutes Catégories) et, pour chaque Film, les candidats inscrits doivent sélectionner la catégorie, parmi les catégories désignées disponibles, sous laquelle ce Film doit figurer. Les Sponsors n’accepteront pas et disqualifieront tout Film qui aura fait l’objet d’une diffusion publique avant le début de la Promotion, ou qui, de quelque manière que ce soit, est en violation du présent Règlement Officiel. Les candidats inscrits doivent inclure avec la soumission de leur Film, le nom légal complet de chaque personne ayant participé ou contribué de quelque façon que ce soit au Film soumis, l’adresse postale de chacune de ces personnes, leur adresse email, leur nom d’utilisateur Xfire ainsi que la catégorie dans laquelle le Film est soumis dans le cadre du Concours (“Informations à Fournir”). Une inscription comprend le Film et toutes les Informations à Fournir, les candidats pouvant choisir, de déposer leurs Films, selon une des deux méthodes suivantes:

Méthode 1: Vous pouvez déposer votre Film sur Internet en suivant les instructions à: http://www.xfire.com/cms/xf_wow_contest_summer_form lequel vous autorise a fournir un URL du Film faisant l’objet de la soumission ; ou
Méthode 2: Vous pouvez déposer votre Film par email, en incluant le Film à un email en temps que pièce jointe, envoyé à partir du compte email de l’utilisateur enregistré Xfire soumettant le Film à: xfirewowmovies@xfire.com. L’objet de l’email avec le Film en pièce jointe doit contenir les mots suivants (et UNIQUEMENT les mots suivants) "WoW Summer Movie Contest" et le corps de l’email doit contenir les Informations à Fournir.
Chaque Film doit inclure des représentations graphiques visuelles claires ou des citations audios de Blizzard Entertainment, Inc. et Xfire, Inc. ou leur logos ou signes d’identification distinctifs et doit, au moins une fois, au début ou à la fin du Film, présenter une des Diapositive d’arrière-plan Noire. Le logo officiel Xfire et autres éléments officiels Xfire que vous êtes autorisés à utiliser dans le Film pour le Concours sont disponibles à:http://www.xfire.com/cms/xf_presskit. Le contenu et le matériel mentionnés ci-dessus fournis pour votre usage relatif à ce qui précède sera considéré, dans le cadre de ce Règlement Officiel, comme faisant partie des Scènes, tel que ce terme a été précédemment défini.
Chaque soumission de Film doit être faite uniquement dans l’un des formats suivants: ".wmv", ".avi", ".mpg", ".mpeg", ".qt," ou ".mov". Pour les catégories Drame, Musique/Danse et Comédies, la taille du fichier ne doit pas excéder 100Mb ou 10 minutes en durée. Pour la catégorie Court-métrage, le fichier ne doit pas excéder 25Mb ou 2 minutes en durée. Tout texte, mot, parole de chanson ainsi que tout autre contenu dans le Film doit être en langue Anglaise. Toute musique dans le Film doit être soit une composition et une interprétation originale du candidat participant, soit la musique du jeu World of Warcraft. Les Films ne devront pas contenir un quelconque matériel qui viole ou est incompatible avec le présent Règlement Officiel ou porte atteinte aux droits d’un tiers, y compris tout contenu qui contient (ou semble contenir), selon l’opinion et le jugement du seul Sponsor:
o du matériel explicitement blasphématoire ou obscène;
- le soutien ou l’approbation de l’usage illégal de drogue, de l’abus d’alcool ou d’autres activités illégales;
- de la nudité, de la profanation ou de violence extrême ou gratuite;
- toute publicité commerciale exprimée ou sous-entendue;
- toute caractérisation péjorative d’une personne ou groupe de personnes basée sur l’âge, la race, la couleur, le genre dans son identité ou son expression, l’orientation sexuelle, les croyances religieuses, la situation matrimoniale, l’incapacité physique ou mentale, la nationalité, les règles et principes de vie, l’origine, l’apparence physique, l’affiliation politique, l’appartenance à un syndicat, ou tout autre facteur éthique ou illégal;
- en violation de ce Règlement Officiel ou des Termes et Conditions de Xfire qui s’appliquent aux utilisateurs de Xfire disponibles à: http://www.xfire.com/terms_and_conditions;
- toute utilisation non autorisée de matériel protégé ou propriétaire, y compris, sans limitation, l’utilisation non autorisée de marque, logo ou le nom d’une personne, une photographie, une voix ou une ressemblance; ou
- les représentations d’une quelconque conduite, façon de parler ou autre contexte jugés inappropriés par les Sponsors ou un des juges sélectionné par les Sponsors.
Participation au Tirage : Vous devez être un utilisateur enregistré Xfire avec un nom d’utilisateur Xfire pour participer. L’inscription en tant que membre enregistré de Xfire est gratuite et aucune obligation d’achat n’est liée à la qualité de membre de Xfire. Le vote aura lieu pendant la Période de Vote sur les Films dans les forums de Xfire dans la section World of Warcraft Summer Movie Contest. Pour participer, vous devez voter pour votre Film favori dans une ou plusieurs des catégories de Film désignées, ainsi que pour le Meilleur Film Toutes Catégories, pendant la Période de Vote sur les Films. Jusqu’à la Date Limite de Vote, les participants éligibles seront autorisés à voter pour leur Film favori au sein de chaque catégorie, sous réserve d’un seul vote par membre enregistré Xfire par catégorie. Le vote se poursuivra jusqu’à la Date Limite de Vote et les résultats du vote populaire des utilisateurs enregistrés de Xfire serviront aider à déterminer les gagnants des prix du Concours tel que décrit ci-dessous. Chaque vote d’un participant correspond à une participation de celui-ci au Tirage. Le vote est identifié par le nom d’utilisateur en temps que membre enregistré de Xfire.
4. Sélection des Gagnants.
Sélection des Gagnants du Concours: Au sein de chaque catégorie de Film, les Sponsors évalueront et sélectionneront cinq (5) Films gagnants, et ceux-ci seront classés par les juges, dans l’ordre de leur sélection, 1er, 2ème, 3ème, 4ème et 5ème au sein de chaque catégorie. Les sélections dans chaque catégorie seront faites par un panel de juges sélectionné par les Sponsors et seront déterminées par les juges sur la base de coefficients comme suit : Forum Xfire/vote populaire (20%); sélections de Blizzard Entertainment, Inc. (40%); et sélections de Xfire, Inc. (40%). Les juges appliqueront des critères, y compris sans que cela soit limitatif, leur appréciation souveraine, aux Films qui présentent l’expression la plus originale, authentique, drôle et/ou artistique au sein de chaque catégorie du Concours, et qui est basé sur le jeu World of Warcraft. De plus, le Grand Prix et les Films méritant une Mention Honorable seront sélectionnés par les juges de la même manière. En cas d’égalité, les juges repasseront en revue et réévalueront les ex-aequos pour déterminer l’ordre ou les sélections. De plus, si un Film, ou un participant ayant soumis un Film, sélectionné comme gagnant potentiel, s’avère être inéligible ou est disqualifié ou n’est pas en mesure d’accepter un prix, les Sponsors auront le droit de disqualifier ce Film et/ou ce participant et les Sponsors auront le droit de faire monter d’un rang, si cela est approprié, et/ou de désigner un autre Film gagnant, parmi le lot de participations restantes, selon le pouvoir souverain et l’arbitrage des seuls Sponsors. Les Décisions et arbitrages des Sponsors auront force obligatoire et seront définitives pour tout ce qui concerne la présente Promotion.
Les participants responsables des Films, sélectionnés de la manière précédemment décrite, seront les gagnants potentiels de prix et seront informés par email environ quatorze (14) jours après leur sélection. Pour être déclaré gagnant au sein d’une catégorie et au niveau désigné par les juges, et pour se voir attribuer et réclamer le prix applicable, les gagnants potentiels de prix devront suivre les instructions, contenues dans l’email d’information, décrivant de quelle manière ils doivent se conformer à ce Règlement Officiel, y compris l’envoi des déclarations et autorisations requises.
Sélection des gagnants au Tirage : Le vote populaire pour sélectionner les gagnants aura lieu sur les forums Xfire, dans la section World of Warcraft Summer Movie Contest. Pour accéder aux forums Xfire, il faut créer un compte gratuit Xfire et devenir un membre de Xfire (http://www.xfire.com/download/ ). Chaque membre Xfire, avec son nom d’utilisateur, a le droit de voter pour le Meilleur Film Toutes Catégories, ainsi que pour son Film préféré au sein de chaque catégorie (ce qui équivaut à un maximum de 5 votes autorisés si un membre vote dans toutes les catégories). Quand le vote est terminé et que la Date Limite de Vote est passée, les Sponsors sélectionneront par tirage au sort 20 gagnants de prix potentiels parmi tous les votes des inscrits qualifiés effectués pendant la Période de Vote sur les Films, et chacun d’eux recevra, sous réserve de son éligibilité, un des Prix d’Encouragement aux Votants décrits ci-dessous. Le tirage pour les Prix d’Encouragement aux Votants aura lieu le ou aux environs du 23 Octobre 2006, et les gagnants de prix potentiels en seront informés par email.
Si un membre de Xfire, sélectionné comme gagnant potentiel, est reconnu comme étant inéligible, est disqualifié ou n’est pas en mesure d’accepter un prix, les Sponsors auront le droit de disqualifier ce membre Xfire du Tirage et les Sponsors auront le droit de tirer au sort un autre nom d’utilisateur Xfire comme gagnant potentiel, parmi le lot des participants éligibles restant. Les décisions et arbitrages des Sponsors auront forces obligatoire et probante pour tout ce qui concerne cette Promotion.
5. Les Prix. Toutes les valeurs
des prix sont exprimées en dollars
(A) Prix du Concours: Dans la partie Concours de la Promotion, il y aura un total de trente et un (31) prix décernés:un (1) Grand Prix pour le Meilleur Film Toutes Catégories, cinq (5) prix, allant du 1er Prix au 5ème Prix, dans chacune des catégories de Films désignés et dix (10) prix pour les Films qui se verront attribuer une Mention Honorable. Si plusieurs personnes sont impliquées dans la soumission d’un Film, les prix seront attribués à l’utilisateur enregistré Xfire qui aura effectué la soumission gagnante.

Pour les 10 Films sélectionnés avec Mention Honorable, chacun des participants gagnants recevra un Clavier Zboard (VMM d’une valeur de $ 50 chacun, soit une VMM totale de $ 500).
VMM totale : montant total des VMM de tous les prix à attribuer dans la partie Concours de la Promotion, soit $ 22 460.
(B) Prix du Tirage (ou Prix d’Encouragement aux Votants) :
Les utilisateurs membres enregistrés de Xfire qui téléchargent et visualisent les Films peuvent soumettre leur vote pendant toute la Période de Vote sur les Films en votant pour leur Film préféré dans chacune des catégories désignées de Film. Bien que les utilisateurs membres enregistrés de Xfire puissent choisir de voter dans n’importe laquelle des catégories désignées de Film, les participants ne peuvent voter qu’une fois dans chaque catégorie et ne reçoivent qu’une participation au Tirage pour chaque vote. Après l’expiration de la Date Limite de Vote sur les Films, les noms de vignt (20) participants remplissant les conditions seront tirés au sort parmi toutes les candidatures admissibles au Tirage au sort, en vue de gagner les Prix d’Encouragement aux Votants décrits ci-dessous.
Les 20 gagnants recevront chacun un clavier Clavier Zboard (VMM $ 50 chacun). Si une candidature ou un utilisateur enregistré de Xfire n’est pas éligible ou s’il est disqualifié pour une raison quelconque, un autre participant sera sélectionné pour ce prix dans la masse des candidatures restantes susceptibles de sélection pour le Tirage au sort.
Le montant total de la VMM de l’ensemble des prix attribués dans la partie Tirage de la Promotion est de : $ 1 000.
Le montant total de la VMM de l’ensemble des prix attribués dans le cadre de la Promotion (Concours et Tirage au sort de la Promotion) est de $ 23 460.
6. Utilisation par le Sponsor des Films et Informations à Fournir. En participant au Concours, vous (et vos parents ou votre gardien légal, le cas échéant) concédez, par les présentes, à chacun des Sponsors, collectivement et individuellement, de même qu’à chacune des Entités Sponsors, à titre gratuit, perpétuel (sauf en France où la durée sera celle de protection des droits de propriété intellectuelle), non-exclusif, irrévocable, pour le monde entier, une licence comprenant le droit de reproduire sur tous matériaux existants ou à créer, de représenter, d’afficher, de diffuser de manière directe ou indirecte, par tout moyen existant ou à créer (y compris des technologies inconnues, à moins que des dispositions d’ordre public de la Loi n’interdise expressément d’accorder des licences en relation avec ces technologies inconnues), d’utiliser et d’exploiter en relation avec cette Promotion et le jeu World of Warcraft, et de considérer comme leur appartenant chaque Film et Information à Fournir, de même que toutes autres informations et matériaux que vous soumettez au Sponsor en relation avec le Concours (les "Matériaux de Participation"). Ces Matériaux de Participation ne seront retournés à aucun Participant et, sans restreindre la généralité de ce qui précède, vous reconnaissez que les Sponsors et les Entités Sponsors auront le droit d’utiliser, de modifier, de reproduire, de publier, de représenter, de diffuser sur toutes formes de supports, de distribuer un nombre illimité de fois, de mettre à la disposition de tiers pour leur propre usage (par exemple, mais sans que cela soit limitatif, la mise à la disposition des participants au Tirage susceptibles inter alia de télécharger les Matériaux de Participation), de créer des œuvres dérivées, de les utiliser dans le cadre de matériels publicitaires ou promotionnels en relation avec cette Promotion et le jeu World of Warcraft, pour une durée illimitée (sauf en France, où la durée sera celle de protection des droits de propriété intellectuelle) et autrement d’exploiter, à des fins commerciales ou non, les Matériaux de Participation en relation avec cette Promotion et le jeu World of Warcraft, pour une durée illimitée (sauf en France où la durée sera celle de protection des droits de propriété intellectuelle applicables) et dans tout l’univers, de toutes les manières ou sur tous les supports, existants ou à créer (y compris des technologies inconnues, à moins que des dispositions d’ordre public de la Loi n’interdise expressément d’accorder des licences en relation avec ces technologies inconnues), sans qu’il soit nécessaire de vous en informer, ni de vous attribuer ce contenu (y compris les indications relatives à la qualité d’auteur), ni de vous rémunérer ou de vous dédommager, vous ou toute autre personne ou entité. Afin d’éviter toute ambiguïté, en France, les droits auxquels il est fait référence dans les présentes comme “perpétuels” ou “sans limitation de durée” ne sont consentis que pour la durée de protection des droits d’auteur et droits de propriété intellectuelle conformément à la Loi. Vous convenez d’engager par la suite, aux frais du Sponsor, toute action (y compris, et sans limitation, l’exécution de déclarations et tous autres documents) qui sera raisonnablement sollicitée par le Sponsor afin de valider, documenter, parfaire ou confirmer les droits du Sponsor exposés ci-dessus dans le présent paragraphe 6. Vous convenez par les présentes qu’à aucun moment pendant ou après la Promotion vous n’exploiterez commercialement le Film soumis par vous dans le cadre de la présente Promotion, ni n’utiliserez aucune Scène de ce Film, autrement qu’expressément autorisé par ce Règlement Officiel. Pour ce qui concerne la mise en ligne ou la diffusion par vous d’un Film à des fins non commerciales ou personnelles, vous convenez également de vous en abstenir et de concéder aux Sponsors les droits exclusifs de diffusion, de représentation, de promotion, d’utilisation et de distribution du Film pour une durée expirant 6 semaines après la date à laquelle la totalité des prix aura été attribuée, et de céder aux Sponsors l’exclusivité sur les droits répertoriés ci-dessus, y compris, et sans limitation, le droit de diffuser, de représenter, de promouvoir, d’utiliser et de distribuer le Film que vous avez soumis jusqu’à expiration d’une durée de six semaines après la date à laquelle la totalité des prix aura été attribuée. Sur demande, nous vous informerons de cette date.
7. Œuvre Originale. Par les présentes, vous garantissez et déclarez qu’en soumettant vos Matériaux de Participation (a) vous êtes propriétaire et détenez tous les droits sur ceux-ci, à l’exception des Scènes et lorsque cela est interdit par la Loi, détenez tout autorisation nécessaire notamment au regard de tout droit moral, (b) tous les Matériaux de Participation, à l’exception des Scènes, sont des œuvres originales au sens du droit d’auteur réalisées par vous ou par les autres participants que vous avez identifiés comme participant ou contribuant à la création et à la production des Matériaux de Participation, (c) vous n’avez pas copié, ni entièrement ni partiellement, d’une quelconque autre oeuvre et vous ne violez pas, vous ne vous appropriez pas abusivement ou ne violez aucun droit propriétaire, droit de propriété industrielle ou intellectuelle, droit relatif à la protection de la vie privée, droit de la publicité, droit de la personnalité ou de la personne ni d’autres droits (y compris, sans limitation, le droit de d’auteur, copyright, droit des marques ou des marques de service) appartenant à d’autres personnes, sociétés ou entités, et que vous ne violez ni n’enfreignez aucune loi, réglementation, contrat ou obligation par lesquels vous seriez lié.
8. Collecte des Informations. Les Matériaux de Participation comprennent les Informations à Fournir qui supposent que vous nous fournissiez les coordonnées permettant de vous identifier individuellement, et qui ne seront utilisées que pour l’administration de la Promotion et vous contacter au cas où vous seriez choisi comme gagnant potentiel ainsi que pour l’annonce des prix conformément au Paragraphe 11. Vous consentez expressément et nous autorisez à transférer vos données personnelles aux États-Unis et à nos fournisseurs, ainsi qu’à d’autres personnes ou entités auxquelles nous recourons pour fournir les prix ou exécuter des obligations en relation avec la Promotion (et à ces fins exclusivement), ou en vertu de dispositions spécifiques du Règlement Officiel ou de la déclaration sur l’honneur, ou de tous autres documents que vous seriez amenés à approuver et signer afin de recevoir votre prix. Les Sponsors ne vendront, ne loueront ni ne transfèreront d’une manière ou d’une autre aucune des données vous identifiant personnellement à aucun tiers qui ne soit pas un de ses affiliés, ni n’utiliseront ces données, ni n’autoriseront personne parmi les Entités Sponsors à utiliser ces données à des fins de marketing sans votre accord. Toutes les données personnelles communiquées dans le cadre de cette Promotion, seront conservées dans le respect de la réglementation applicable sur la protection des données pour la seule durée qui nous est nécessaire afin de remplir nos obligations relatives à cette Promotion, à l’exception des données personnelles que vous avez communiquées lors de votre enregistrement en qualité d’utilisateur et de membre de Xfire qui demeureront soumises aux conditions générales applicables au dit enregistrement en qualité d’utilisateur Xfire. Si nous devions découvrir qu’un participant ayant soumis des Matériaux de Participation est un résident de l’Union Européenne d’un âge inférieur à quinze (15) ans, outre le fait de disqualifier sa candidature, le Sponsor effacera et détruira toutes les données personnelles livrées avec ses Matériaux de Participation.
Nous nous réservons le droit de diffuser votre nom, si vous êtes le gagnant d’un prix, avec les noms de tous les gagnants de cette Promotion.

9. Renonciation et Décharge de Responsabilité.
En participant à la présente Promotion, en soumettant des Matériaux de Participation et/ou en acceptant ou en recevant un prix, vous reconnaissez et convenez que :
(a) Les Entités Sponsors seront déchargées de toute responsabilité dans les cas suivants : (i) transmission ou participation tardives, perdues, acheminées à une mauvaise adresse, illisibles, imperceptibles, tronquées, déformées ou endommagées ; (ii) retards, dysfonctionnements ou pannes téléphoniques, électroniques, de hardware, logiciels, de réseau, Internet, ou autres de nature informatique – ou en relation avec les communications ; (iii) interruptions, accidents corporels, pertes ou dommages causés par des événements échappant au contrôle des Sponsors ; ou (iv) toutes erreurs de transmission, d’impression ou de typographie susceptibles d’intervenir ou d’être découvertes ;
(b) La preuve de la soumission d’une participation ne constitue pas la preuve que celle-ci a effectivement été reçue, et s’il y a un dysfonctionnement, un retard ou un quelconque problème concernant votre participation, que la cause en soit l’un des éléments décrits ci-dessus en (a) ou toute autre raison, les Sponsors se réservent le droit souverain d’annuler cette participation ;
(c) Sous réserve des interdictions et/ou restrictions résultant des dispositions impératives de Loi ou d’une réglementation qui vous est applicable, vous déchargez les Sponsors, de même que les Entités Sponsors (individuellement et/ou collectivement, les "Parties Déchargées") de toute responsabilité, et vous renoncez à entreprendre toute action, quelle que soit sa forme, son motif ou son fondement, concernant toute réclamation, tout coût, toute dépense, tout accident corporel, tout perte ou tout dommage, de quelque sorte que ce soit et résultant ou en relation avec la Promotion ou l’un des Prix y compris, et sans limitation, toute réclamation, tout coût, frais, dommage ou destruction subis par un bien, les droits concernant la publicité, la protection de la vie privée, la diffamation ou la calomnie, sur le fondement du droit des contrats, de la responsabilité civile (y compris le cas de négligence légère), de garantie ou d’autre théorie, et
(d) À condition d’être déclaré gagnant, de vous voir attribuer et de recevoir un prix, chaque gagnant potentiel (y compris tous les participants répertoriés et nommés avec le participant soumettant un Film en particulier) devra individuellement signer et faire parvenir aux Sponsors une Déclaration sur l’honneur concernant son Éligibilité ainsi qu’une Renonciation de Responsabilité/Accord de Publicité, ce qui inclut également l’acceptation et la confirmation de s’être conformé à toutes les conditions de ce Règlement Officiel.
10. Liste des gagnants ; Règlement officiel. Pour obtenir la liste des gagnants, veuillez envoyer une enveloppe au format commercial, timbrée et portant votre adresse, après le 30 Octobre et avant le 31 décembre 2006 au nom des Sponsors à l’adresse suivante : "Blizzard Xfire World of Warcraft Summer Movie Contest" - Winners List Request (demande de liste des gagnants, c/o Blizzard Entertainment, P.O. Box 18979, Irvine, CA 92612). Pour obtenir un exemplaire du Règlement officiel, vous pouvez vous rendre sur le site http://www.xfire.com/cms/xf_wow_contest_summer ou envoyer une enveloppe au format commercial, timbrée et portant vos nom et adresse au nom des Sponsors, à l’adresse : "Blizzard World of Warcraft Summer Movie Promotion" – Official Rules Request, c/o Blizzard Entertainment, P.O. Box 18979, Irvine, CA 92612, USA. Les résidents de France ne sont pas tenus d’envoyer une enveloppe timbrée pour le retour et les frais d’affranchissement postal au tarif ordinaire pour cette demande seront remboursés aux participants qui en feront la demande à cette adresse. En outre, ce Règlement Officiel a été déposé auprès de Maître Jean-Louis Hauguel, Huissier, domicilié au 14 rue du Faubourg Saint-Honoré, 75008 Paris.
11. Divers. La Promotion et le Règlement Officiel, de même que tous matériels, documents, déclarations sur l’honneur, décharges et autres accords et obligations mentionnés et auxquels il est fait référence dans cette Promotion, seront régis et interprétés conformément aux lois allemandes. Les participants conviennent de se conformer au Règlement Officiel et aux décisions des Sponsors et des juges, qui seront définitifs et sans appel possible à tous égards. Les Sponsors se réservent le droit de modifier ce Règlement Officiel à tout moment, à leur seule discrétion et, sans préavis, de modifier, suspendre ou annuler la Promotion entièrement ou partiellement, ou encore la participation d’un concurrent si une cause échappant au contrôle du Sponsor, ou un autre événement devait affecter la gestion, la sécurité ou la direction appropriée de tout ou partie de la Promotion, ou dans le cas où les Sponsors se trouveraient, pour toute autre raison (déterminée selon leur pouvoir souverain), dans l’impossibilité de gérer cette Promotion comme ils en avaient eu l’intention. Les Sponsors, dans l’exercice de leur pouvoir souverain, et à l’occasion de toute cessation de la Promotion, peuvent faire intervenir les juges afin de déterminer quels sont les gagnants des prix du Concours et/ou les Sponsors peuvent procéder au tirage au sort des gagnants du Tirage, entre les inscriptions éligibles reçues jusqu’à la date de la cessation en question ou pourront utiliser toute autre méthode d’attribution des prix qu’ils jugeraient appropriée, et conforme au Droit et à la réglementation en vigueur. Les Participants, qui enfreindraient le Règlement Officiel, qui tenteraient de falsifier la Promotion ou qui commettraient une action nuisible ou déloyale à l’encontre des Sponsors, de la Promotion ou d’un autre participant (dans tous les cas sur décision souveraine des Sponsors), seront disqualifiés et éventuellement reconnus en situation d’infraction à la loi, à la réglementation ou à un traité international et passibles de poursuites civiles ou pénales. Les Sponsors se réservent le droit de disqualifier, interdire d’inscription, de participation, de vote ou encore de toute autre participation à cette Promotion toute personne dont l’éligibilité est suspecte, ou qui ont été disqualifiés ou qui encore, pour toute autre raison, ne peuvent prétendre s’inscrire et participer à la Promotion ou qui contreviendraient au Règlement Officiel. Sans limitation des critères et obligations résultant des déclarations sur l’honneur, affirmations ou décharges en vertu des présentes, et sauf interdiction ou restriction conformes à la Loi, l’acceptation d’un prix constitue l’autorisation, dans le cadre de la Promotion et concernant les Films soumis, des Entités Sponsors d’utiliser le nom du gagnant (ou des gagnants si plusieurs participants sont concernés), sa photo (leurs photos), son image (leurs images), ses (leurs) déclarations, des éléments de sa (leur) biographie, sa (leur) voix, son adresse, dans le monde entier, sur toutes formes de support, connues à ce jour ou à venir, ou en cours de développement, sans limitation de durée (sauf en France où la licence n’est valide qu’aussi longtemps que s’appliquent les droits de propriété intellectuelle), sans préavis, attribution, reddition de compte ou compensation de quelque sorte que ce soit.
