MOVIE “EARLY BIRD” CONTEST
OFFICIAL RULES
Definitions
A. Sponsors – Conopco, Inc, a Delaware
Corporation, d/b/a Unilever for its
B. Contest – Axe Machinima Movie Contests described in these
rules.
C. Start Date – The Contest shall commence on

States of Florida and Rhode Island) 18 (eighteen) years of age or older on the
Start Date, who agree to comply with all terms and conditions of these Official
Rules and who own a licensed copy of any of the Authorized Games as of the
Start Date.
E. Publishers – Game publishers who have agreed that Entrants
may use publishers’ games in their movie entry to the Axe Machinima Movie
Contest.
F. Minors – Entrants who are under the legal age of majority in their
state of residence.
G. Deadline - The Contest shall end on

1. Disclaimer. By entering this Contest, Entrants release Sponsors,
all Publishers and any and all of their respective parent companies,
subsidiaries, affiliates, directors, officers, professional advisors,
employees, agencies and representatives from responsibility for: (a) any late,
lost, misrouted, garbled or distorted or damaged transmissions or entries; (b)
telephone, electronic, hardware, software, network, Internet, or other
computer- or communications-related malfunctions or failures; (c) any Contest
disruptions, injuries, losses or damages caused by events beyond the control of
Sponsors; or (d) any printing or typographical errors in any materials
associated with the Contest.
2. Minors. To qualify as Entrants, Minors in the state in
which they are resident must have one of their parents or legal guardians
submit with the entry a signed, written statement that they have read,
understood and agreed to these Contest rules, and that such agreement
constitutes acceptance of these Contest rules.
3. Eligibility. To enter the Contest, Entrants must submit
qualified entries between the Start Date and the Deadline. Directors,

All prizes will be awarded. Prize Winners must timely execute an Affidavit
of Eligibility and other documents specified in these Contest rules, to the
extent permitted by law, before winners can receive any Prize awarded. Prizes
returned as undeliverable or otherwise not claimed within fifteen (15) days
after delivery of notification will be forfeited and awarded to an alternate
winner. Prizes are not transferable. No substitutions or exchanges
(including for cash) of any prizes will be permitted, except that Sponsors
reserve the right to substitute a prize of equal or greater value for any
prize. Limit one prize per household or address.
5. How to Enter. To submit an entry, Entrants must send an e-mail to axemoviecontest@xfire.com specifying the
following: legal name of Entrant, postal address of Entrant, e-mail address of
Entrant, telephone number of Entrant, and URL to Entrant’s movie submission in
the format and with the characteristics specified in the subsequent paragraph,
and legal names and ages as of the Start Date of all contributors to the movie
submission.
Movie submission must be an original, not previously published, digital
machinima movie meeting the following requirements. The movie must consist of

(collectively, “Authorized Games”); must be based on the theme of
The Gamekillers described at www.gamekillers.com must be submitted in
".wmv," ".avi,"
".mpg," ".mpeg," ".qt," or ".mov" format only; must be in a file not exceeding 150
Mb in size; must be under 10 minutes in length (not including the slide presentating the sponsors); must use only original lyrics
and dialog in the English language and must include Entrant’s original music or
music from the Authorized Games (“Authorized Music”); must not feature explicit
or obscene language or nudity, be in bad taste or controversial in the way it
portrays any group or individuals, portray
Each movie should include a screen of the Xfire logo (Xfire_Logo.eps
or Xfire_logo_sheet.jpg) and the slide featuring the
sponsors (sponsors_slide.jpg), which can both be
downloaded in the “Gamekillers Package” by visiting
the "The Gamekillers package" section of
the contest webpage at http://www.xfire.com/xf/modules.php?name=XFire&file=cmspage&body=xf_axe_gamekillers

address listed above. All questions should be directed to the dedicated Xfire

Entries, including movie submissions, will not be acknowledged and cannot be
returned.
6. Winning. After the Deadline, a panel of judges chosen by
Sponsors shall choose the winners from all Entrants who have submitted an entry
including a movie submission meeting all requirements specified in these
rules. Winners and any alternate winners that should be needed shall be
chosen by judges at their sole discretion based upon judges’ evaluation of the
criteria of originality, creativity, humor, and execution of Gamekillers theme, with each criterion given equal
weight. The decision of the judges is final and binding. Sponsor Xfire
will notify prizewinners by e-mail within fourteen (14) days of the judges’
decision. To claim the prize awarded, each winner must follow the
instructions contained in the notification he or she receives, complete, sign
and return as specified in the notification all documents requested, including
properly executed and valid release forms for all persons featured or who can
be heard in the movie submission, within fifteen (15) days from the date of
notification. Any winner who is a minor in the state in which he or she
is a resident must have one of his or her parents or legal guardians complete,
sign and return all documents requested in the winner’s notification.
7. Sponsors’ Use of Entries. By submitting an entry, Entrant
hereby agrees that in consideration of Entrant’s being allowed the chance to
enter the Contest, Entrant hereby grants Sponsors and each Publisher a
perpetual, non-exclusive, worldwide license and right to utilize the entry and
other materials that Entrant submits, including the movie submission
(collectively, "Entry Materials"). Without limiting the generality of
the foregoing, Entrants acknowledge that Sponsors and each Publisher shall have
the right to use, modify, reproduce, publish, perform, display on all forms of
media, distribute, make derivative works of and otherwise commercially and noncommercially exploit the Entry Materials in perpetuity
and throughout the universe, in any manner or medium now existing or hereafter
developed, without separate compensation to Entrant or any other person or
entity. Entrant agrees to take, at Sponsors’ expense, any further action
(including, without limitation, execution of affidavits and other documents)
reasonably requested by Sponsors to effect, perfect or confirm Sponsors’ and
each Publisher’s rights as set forth above in this paragraph 7. Entrant hereby
agrees to give Sponsors and each Publisher an exclusive on all distribution of
the movie up till a period of one year from the conclusion of the
competition. Neither Sponsors nor Publishers shall have any obligation to
publish or display the movie submissions of Entrants, but may do so in their
sole discretion.
8. Restriction on Use of Sponsors’ Intellectual Property. Axe
is a registered trademark of Unilever or its affiliates; Xfire is a mark of
Xfire, Inc.; the images, sounds, and other content contained in the Authorized
Games are protected by copyright and other intellectual property protections
and the Games’ brands are trademarks owned by the Publishers
(collectively, “Intellectual Property”). Entrants are permitted to use Intellectual
Property only to the extent necessary to create movies for submission to this
Contest and for no other purposes. By entering the contest, Entrants
acknowledge that any public or commercial use of materials containing
Intellectual Property apart from the Contest requires written permission from
the Sponsors and/or Publishers.
9. Original Work of Authorship. By submitting an entry,
Entrants hereby warrant and represent that all Entry Materials submitted by
Entrant do not violate, misappropriate or infringe any copyright, trademark or
other proprietary right of any other person or entity or require the consent of
any third party beyond the permissions granted under these rules.
10. Collection of Information. The Entry Materials require Entrants to
enter their name, e-mail address, mailing address and state of residence. This
information will only be used to contact Entrants in the event that they are
chosen to receive a prize, and as identifying information for any Winners List
provided to the public. Sponsors will not sell, rent or otherwise transfer this
information to any third party, nor will Sponsors use this information for
marketing purposes without Entrants’ consent. Use of the information
submitted otherwise shall be consistent with Xfire’s
privacy policy located at http://www.xfire.com/xf/modules.php?name=XFire&file=privacypolicy.
11. General Release. By entering the Contest, Entrants release
Sponsors, Publishers, and any and all of their respective parent companies,
subsidiaries, affiliates, directors, officers, employees, legal
representatives, agencies and professional advisors (collectively, the "Released
Parties") from any liability whatsoever, and waive any and all causes of
action against the Released Parties, related to any claims, costs, injuries,
losses, or damages of any kind arising out of, or in connection with, the
Contest, the preparation of any Entry Materials or delivery, misdelivery, acceptance, possession, use of or inability to
use any prize (including, without limitation, claims, costs, injuries, losses
and damages related to personal injuries, death, damage to or destruction of
property, rights of publicity or privacy, defamation or portrayal in a false
light, whether intentional or unintentional), whether under a theory of
contract, tort (including negligence), warranty or other theory.
12. Affidavit & Release. As a condition of being awarded any
prize, winners will be required to execute and deliver to Sponsors a signed
Affidavit of Eligibility, which includes an acceptance of these Official Rules,
a release of liability and, to the extent not prohibited by law, a consent to
use winners’ name and likeness, among other documents that may be specified in
the winner notification.
